Doubt about child birth after receivng immigration visa

Dear All,

Thanks to Psingh, Sabuj, Libra and everybody for this informative forum

Me and my are expecting a baby in January 1st week 2008. Our visas have not been stamped and we have reveived a letter from New York suggesting that we submit our passports for the visa stamp.

They have also written that we sould not submit our passports if we are expecting a baby and are unable to land before the baby is born. They recommend that we land before the baby is born. Failing which we will have to submit a new application with new fees for all appicants.

I now have three options:

1. If we land in Canada before the Due Date. But since we will not be covered by OHIP, the medical costs and the associated stress for travelling and moving to a new country will become unberable.

2. We land in Canada to fulfil the landing requirements and come back to our country for the delivery. Later on we sponsor the baby. This is a more lengthy process.

3. We inform the consulate of our situation and do not submit our passports now. Once the baby is born, will we have to file a new application all over again as stated in their letter or will the process be more simpler than that.

Kidnly advise.

Hi Libra,

Being in situation like psingh, Me and my spouse surrendered our visas due to child birth. Now that we are blessed with a baby boy, could you please help me out with following queries :
1. "Child Birth Certificate" - Will Certificate issued from hospital suffice or I have to wait for Birth Certificate from Local Municipality which takes some time.
2. For now I am asked to submit only "Child Birth Certificate" and "Photographs" of child. There is no mention of "processing fee" of child. Will I will be asked for it later or Should I send draft for processng fee with Birth Certificate ??
3. Last thing do we need name proof of child at this stage as name is not mentioned in Birth Certificate issued from hospital.

Hi Anujgarg,

I cannot say which option is best for your family - that is your decision to make.

With regard to your third option:

You did not say when you took your medicals initially. Usually, CIC has an applicant's landing date to coincide with 1 year after your medicals were done. Anyway, with the birth of your baby in January, and with you adding the baby to your application, it is very likely that your new landing date will be more than a year from your initial medical exam.

So, when your baby is born, you only have to add the baby to the family by filling in new application forms, BUT NOT reapplying. Reapplying means going through the process all over again including proof of diplomas, references from employers, and the initial processing time frame for your location. So, you will not be doing any of that.

But if you have to add your child to your family, it means you have to fill in a new application form, which CIC will send to you - remember when you filled your forms years ago, your child's name was not in it - so, the forms that you filled at that time are no longer accurate, but obselete. Therefore, adding the child as a family member means filling in new application forms. It does NOT mean that you are reapplying.

Then your child would have to undergo and pass the medical exam. You and any other current members of your family would likely undergo the medical exam again, and pass it again. But wait until CIC makes that request for the medical exams.

You will have to pay the required application fee just for your baby.

I believe you might have to show a new amount for proof of funds since your family is expanded by one - check with your consular office about that: http://www.cic.gc.ca/english/information/applications/guides/ESap4.asp

Upon successful medical exams, you will be issued a landing date for all of your family including the newborn.

Wait for Birth Certificate from Local Municipality - as CIC will only recognize a Birth certificate with the child's name on it. This is because CIC needs the child's name and proof of it.

If you have the required amount for the current processing fee for the child, send it along with the Birth Certificate and Photographs. Currently, I believe the processing fee for your child is CAN $150. Check their website before sending this amount. CIC needs the child's name and proof of it. Without the child's name, the child cannot be added to the application. And, you just cannot tell them the child's name without having the Birth Certificate to prove it.

Our medicals were done on the 20th of June 2007. With the baby expected in Jan 2008 and all the formalities that follow, I beleive that all of us may have to go for medicals again. Which is not a problem.

Only thing that got me concerned and I quote form the letter " DO NOT SUBMIT YOUR PASSPORT AT THIS TIME - if you intendto give birth or adopt a child prior to your landing in Canada ( if you are expecting a child and are able to land in Canada before the child is born, you should do so. Failure to land before additional dependants are born will result in the need for a new application and a new fee for all family members. ) "

This part got me little confused. The fees is not a problem. But since I am in India now and I had applied from buffalo as I was in Canada then, will we have to send the application to buffalo or will the new application go to New Delhi where the processing times are half a decade long.

I hope that it is a continuation of the same application bearing the same file number and not treated like a completly new appliaction.

Please advise.

Hi Anuj,

I know you are willing to do the medicals again, but it is a possibility that after your baby’s positive medical results, you might have a landing date by June 20th of 2008 – and, if that might be the case, it is likely that you might not redo yours and your wife’s medicals.

Now to the quote in your last post:

The reason for passport submission: Submission of passports means that CIC will affix the PR visas for you and your wife and any other family members if applicable to you.

What CIC is trying to tell you in their letter by implied analysis is this:

The visa stamps and the processing of the visas demand our time and man-hours plus printing costs too.

So, if you know that you intend to have or adopt a baby before you land, please do not waste the demand on our time, plus the man-hours and printing costs by having us issue you a visa now and then later on, because of the new addition to the family, you will have us to reissue your family new visas with new landing dates.

Therefore, it will be best if you hold on to your passports now, and inform us of the baby’s expectancy date in the interim. And then, after the baby is born, we can continue with the process by filling in the application forms again in order to add the baby’s name to your family, which will also include a positive medical processing for the baby, and afterwards we will finally request for the passports to affix visas for all family members – old and new.

Thank you for your understanding, and for not having us to waste time and money by affixing visa stamps twice.


Anuj, I hope you understand that what I just wrote “by implied analysis” are not the exact words of CIC.
Rather, I wrote the above to make you understand the logic /reasoning, or administrative policy behind CIC’s statement to you that you quoted in your last post.

So, I hope that you now see where CIC is coming from with their request.

You need to contact Buffalo now and inform them of the following:

1. Provide your file number, and other Buffalo requirements for proper identification
2. The baby’s expectancy date
3. Let them know that you will not be sending the passports at this time as per their request since you intend to have the baby before you land
4. Tell them that you are currently in India and provide the address
5. Ask them to inform you about any steps that they need you to take

Adding the baby to the family is a considered a continuation of the process.

(Applicants only reapply when they’ve been denied initially, or when they failed to land before /by the landing date given to them, or when CIC finds out that an applicant initially made a misrepresentation. Adding a baby to the family is not grounds for reapplying unless medical results come out negative, and I seriously doubt that this will happen).

You will still be treated as a Buffalo applicant.

Buffalo has the discretion to maintain communication with you by email, or to use the Canadian High Commission in New Delhi as their agent.

Just in case you used a lawyer as a representative for your immigration, then you do not need to tell CIC about your India address – as CIC will be communicating with you through your lawyer and not you directly.

Hi Libra

But I have seen that the NYC office or the Buffalo office don't respond to the email. I had emailed them 4-5 days back to check the procedure of how to surrender my immigration for a later landing date but no one replied. Finally I have send them a letter through USPS...hope these guys reply.

Dear Psingh,

I am very sorry; I was caught by bad viral fever and was bedridden entire week and could not login..

Libra has given you the correct email ID of your visa issuing office. I sent email to my visa issuing office, i.e. London office (re-london-enquiry@ international.gc.ca) and they responded to me within two days (though they mention that it may take 4 weeks to have the reply from their office). You do not require to send letter.

We will prefer to stay in such an area from where we can visit those offices where we will have to complete the formalities relating to SIN, PR etc. You know that my wife will be in her 27th week’s pregnancy and we will try to avoid extra traveling.

What about the hotels near the Pearson Airport? Thanks for your cooperation.
