If your husband's divorce wasn't finalized when he married you, then your marriage is not valid in the eyes of CIC. So I'm not sure it will even help to send in the application later, after you get the divorce finalized.

Either way, I don't think you have a chance to be sponsored as a spouse, you can maybe try for common law (if you lived together for 1 year and can prove it).

If I understand the situation correctly, you have married your husband even though he was still previously married to his first wife. The divorce is pending, but not yet finalized. You have sent in the sponsorship package for yourself, but now are trying to add a dependent? Is that correct?

This is the situation as it stands. Your husband can NOT sponsor you at this time. Your marriage is NOT legal in Canada. Your husband needs to finalize the divorce from his first wife and THEN you and he can legally marry (again). You could then apply for sponsorship provided no other laws were 'disregarded' in the process you have already begun.

Either way, if you keep the current application open and try to finish the sponsorship, you are going to be in for some very disheartening news sooner than later. CIC WILL learn about this and your entire family will then be at risk for being deported from Canada and loosing the ability to immigrate here. Don't make things worse for yourself or any unsuspecting children. Withdraw your application. Let your husband finalize his divorce and then remarry him.
