Hi,

I received an email from CIC that I had to undergo my medical exam within 60 days. The email is dated August 13, 2014. I completely forgot about this because of family issues, so I did it right on October 13th, 2014. It is technically 61 days from the day of the letter.

Did I make it? It worries me now.. They never contacted me about it.. Yesterday they only asked about the receipt for the Right of Permanent Resident Fee that I paid already.

Can someone enlighten me? Should I contact the VO?

Now you mentioned that you did your medical exam 61 days after MR, 1 day past the deadline, because you forgot due to family issues. Are you still here in Canada? Do you have legal status here?

Yeah, it just happened that I was checking the first few posts to understand their situation better, and I got even more confused instead. Then after I posted my last comment, I found out that the wife originally used the account.

Original poster, you could be in trouble now due to overextending your stay without legal status. After the 90 days grace period, if you didn't restore your status, you need to leave Canada to do so within 3 weeks to 6 weeks in general. That's according to what the CBSA officer told me when I called. And then, you can restore your status in your country of citizenship, and return here. Even though the immigration office might not realize that you overextended your stay here, they will found it out sooner or later. I believe one of the questions in the landing paper was whether you have any criminal records/refused entry or lost status/overextending your stay. The CBSA officer will verify them with you.

The OP hasn't been working for a while since Feb 2014. Then, when he got MR on Aug 13th, 2014, he was worried about his situation and posted here to inquire about his situations right away. After that, he missed 60 days deadline because he forgot due to family issues. This case has a lot of red flags...

Thanks for the reply! And sorry about the confusion... This account was used by a number of different people. And you're right - my wife posted here too.

My case did raise a lot of red flags - I realized that when I overstayed. I am very much aware that I have jeopardized my chance of becoming a permanent resident.. I'm really being clumsy and have to pay the price for this :( I'm back living in Malaysia now and did my medical exam here.

Questions for you:
1. Let say I get the landing paper and I go back to Canada to land. Isn't it too late to ask that question at the border whether I have overstayed or not? If they find out at the border, will they send me back home right away?

2. Do you know any cases where people overstay but still become a permanent resident anyway?
 
1. You will need to explain them your situation and justify the reason for your overextending stay here in Canada. Immigration VOs might not realize that you did, but CBSA officers most likely will find out. Therefore, you might need to consult your case with immigration experts or lawyers.

2. After the restoration of my work permit status was refused, I immediately called both immigration and CBSA office to understand my options. Different officers had different opinions, but major consensus was that I had to leave Canada immediately within 3 to 6 weeks, since I didn't have any deportation order. So I left within 2.5 weeks and went back to my country to apply for a visitor permit, and came back to Canada after 1.5 months. Within few months, I was fortunate enough to get quick MR, RPRF, and also PPR. Then, I went back to my country again for a special occassion and I have landed few months ago as PR. During my landing in YVR airport, other than the lineup, my process didn't take more than 5 minutes, as I had truthfully explained my situation to the CBSA officer.
