Does my Scenario qualify for Inland Sponsorship?

Hi everyone:

I'll try to summarize my situation.

I'm currently a refugee claimant but am doubtful that I will be able to attain refugee status. I currently do not have any status here in Canada aside from this. I have a child from a first marriage and remarried here in Canada about 4 months ago to a Canadian. I do not have full-custody over my child who is with us here in Canada. We are thinking of having my husband put in an application for sponsorship here before my next hearing, next month.

I guess my question is, would I qualify for an inland sponsorship? What are the possible outcomes or scenarios that can arise from this, considering that I am currently a refugee claimant? If my refugee case doesn't go through and they issue a deportation date, can an inland sponsorship package alter this in any way?

I've already tried to extend my visa early last year but was rejected. I even attempted an appeal but still haven't received any answer. This was before remarrying. I also applied for and was rejected for the Humanitarian and Compassionate Grounds program prior to applying for refugee status (once again before remarrying).

Any tips or information would be greatly appreciated since it's very overwhelming for us.

As what I have read in the thread here, yes you can apply inland since you dont have your Pre Removal Risk Assessment yet. I will encourage you to submit your application ASAP so you can benefit the Administrative Deferral. CBSA will confiscate your passport and travel docs if you are failed refugee claimant.But since you havent had that incident in the present. its a good time for you to submit your application sooner than later.

As long as you have all the proofs that your relationship is genuine. You can be qualified to apply inland.

As the OP applied for Refugee status after 29/06/12 then s/he no longer gets a PRRA unless 12 months have passed since the claim was rejected.

They will take my documents away for sure? What is the reasoning behind this?

And at what point in the sponsorship application would the Administrative Deferral come into effect?

Does this mean that they will issue a removal date if the refugee claim is rejected? Even if the sponsorship application is put in?

Just for general knowledge about how much time I have to play with, my next hearing is scheduled for late March.

they will not deport you unless you have application for Sponsorship on process. They are waiting for the result. If your application is approved for Stage 1, they can not deport you unless they will refuse your application. you have to go home in 30 days after the refusal.

I heard a lot of failed refugee applicants here that their passport were confiscated. CBSA will try to go after you after your claim will get refused.

Apparently the `Administrative Deferral' ended in November 2011.

Sooner or later they will tell u to go home. Go home and apply outland. I overstayed my visa and had no status in canada, had a pending inland sponsorship...they confiscated my passport and told me to go home.

Hi svetlana,

I was out of status for 2 months now as well. I just sent my app last 2 wks ago. I was a previous Temporary Foreign Worker but my restoration got refused last November 29,2013.

I applied for Common-Law since Ive been living with my partner since July 2012. I hope CBSA will not go after me since I applied when I was out of Status...

Im kinda scared but Im behaving myself and not trying to work under the table or any activities that may cause deportation. Most of the causes they will deport those people even if they had ongoing inland applications if they engaged in illegal activities like working without a permit and any criminal activities...

The strange thing is, that a person that is out of status (deemed to have `Lack of Status') can also pertain to someone that is working without authorization.

Yeah Im know its kinda confusing..Ponga if u dont mind me asking. You said you were out of status before you applied too. How many months you were out of status before you sent your application?

Hopefully for u everything will be ok. The new law says that even if u are out of status u can be sponsored and wait for the decision. But in many cases CIC and CBSA doesnt care about this. I got refused for my work permit too, then applied to restore my status and got refused and told them that i have a pending inland sponsorship...anyway i had to go home. It was a nightmare. i came home and apply outland. did you receive the sponsor approval?????

Hopefully for u everything will be ok. The new law says that even if u are out of status u can be sponsored and wait for the decision. But in many cases CIC and CBSA doesnt care about this. I got refused for my work permit too, then applied to restore my status and got refused and told them that i have a pending inland sponsorship...anyway i had to go home. Not yet, I applied last few weeks ago. I was out of status for 2 months before I sent my Sponsorship. So, Im hoping and praying that CBSA will not to after me. Anyway, CBSA will expedite the inland application process for 60 days for the AIP. So, I hope this scenario works out well for me.

How many months you were out of status in Canada before you send your inland application? Ive seen some applicants here that were out of status for 8 months or even a year and didnt receive a removal order. So, Fingers crossed It will work out in my side.

ive been living with my partner for 1 yr and half so I applied straight away for Family sponsorship Common-Law Class...AIP is 8-7 months processing right now. So maybe the result, it will be around Sept/Oct this year, Fingers cross Halifax CBSA will backed out since we talked to the CIC officials when I had my TFW restoration refused . They put in my files that I am applying for Common-Law..just to let the CBSA know about my case..
