Does application to extend as visitor void work permit?

My partner is on IEC work permit that expires April 25th, 2020. We've submitted a Common Law PR application + OWP which was received January 31st. As I understand it, if our application is returned for any reason after April 25th, my partner will be out of status and then not eligible for OWP if we reapply. We want to extend status as a visitor after the work permit expires just in case.

If we apply now for extension as visitor, and the PR application is returned, we can reapply with OWP which is fine.
If we apply now for extension as visitor, and the PR application isn't returned but the visitor extension is approved, does that mean my partner will lose her implied status as a worker and can no longer work?

No - it doesn't mean this. Your partner can continue to work. The only scenario where your partner would have to stop working is if the spousal sponsorship application is returned as incomplete.

Okay, thanks. So even if our visitor extension was approved, if the application isn't returned, she can continue to work regardless.

Correct. The extension is good insurance in case the application is returned. I would personally apply. No downside except money.

We'll do that! Just one more question for you :rolleyes: it mentions on their website it's ideal to apply 30 days before the current status expires to apply for the visitor extension. I'm guessing as it's not a requirement, we're okay to apply now (only 14 days until current status expires)?

It's a guideline - not a requirement. Extension application needs to reach IRCC before IEC expires.
