does anyone know if asylum applicant in USA are eligible for FSW application

My husband applied for asylum in USA and got rejected
I am applying for FSW and will have to show this in background declaration form.
Does anyone know how this migt affest our application
We were never illegally present in USA but applied for asylum when we were on B1/B2 visa
Please give your inputs

Since he's not applying for asylum in Canada, I don't think it matters that he did in the US.
