This is a question to someone who has already been into this situation or any senior who exactly knows about it:

Generally if someone has a valid US visa he do not need to re-apply again if his passport expires or he has a new passport. he can travel to US without transferring the VISA to his new passport (or getting a new visa). he must JUST have both passports in his possession when he travels. ( e.g the expired one with US visa and the new blank one).

1) Now my question is that if a protected person (refugee) in canada gets a travel document and if at same time his home country passport is valid and having a valid US visa on it. can he travel to US? i mean without re-applying for a US visa on the travel document.

2) as he already has a valid US visa, can he travel to US with having both the travel document and his home passport in possession when travelling?

I believe this scenario is impossible, because Passport Canada will NOT issue to you Travel Document if have your passport and you allowed to use it. Unless, you already is a permanent resident of Canada and you have your PR Card. In this case, might possible.

A refugee in canada can apply for a travel document and can travel outside of canada even before getting PR card/Permanent residence status. i know this because i know many who had traveled even before getting a PR status. some have even got their home passports and they are now in possession of both travel document and their home country passports.

My question was can a refugee travel to US if he has a valid US visa on his country passport and he also hav a travel document with him or will he need to get a new visa on his travel document before he travel to US.

A simple call to us embassy in Toronto will give you the accurate answer.

It is simple. Any usage of your passport might cost you refugee status in Canada. It is something called reavailement. If it will or not will depend how your case would be approached.

Additionally, USA and Canada do share info (among other about status of that person in their country). So having a piece of paper stating that it is still valid in your passport may not make it valid. Because just like Canada, USA can also revoke any visa they have approved in the past.

So if you like a "Russian roulette", try to use your passport. Otherwise ask for refugee travel document (and yes you will need it even if you will be a permanent resident to travel abroad to most countries). And then of course you need to ask for fresh visa for that document from USA (again, simply because the circumstances on which your previous visa were issued are no more valid). Hello I am in the same situation, I have a valid US visa in my old passport (not the one I gave up) and was wondering if I could travel with that one and my RTD. How did it turn out for you?

You should really be reapplying because your situation has changed dramatically. You shouldn't be using your home country passport for anything.
