You should apply for divorced before landing. And inform CIC that you, the primary applicant, is not married any more and do not want to include your spouse in the application. If you qualify by yourself, then they will send you an updated COPR and you can land single.

I or we are yet to land in Canada. How can I inform CIC after filing divorce? I mean the mode of communication.
 
But my case is genuine. My current marriage is 5yrs old. I just happen to be in such a situation that my marriage is falling out after I applied for PR. And we both don't want to let go off the chance to get a PR. Is there a way out? How long should we wait after getting the PR so as it doesn't seemed to be a case of cheating?

What happens if I apply for divorce before entering Canada? What effect will it have on our PR considering me being the primary candidate?

This forum is not the place to ask for advice on how to commit immigration fraud. You are legally required to inform IRCC that your marriage is over and remove your ex from your app.

It is not an advice on fraud I am asking for. As I said mine is a 5yr old marriage. My case is genuine. We have got the visa but we are yet to land. Even if I file for divorce now, can you guide me how can I inform IRCC?

Guys! Instead of quoting again and again that it's fraud, I would really appreciate if someone can direct me in the right direction where I can resolve my situation in the right way. That is why I have asked this question in this forum.

Raise an URGENT Case Specific Enquiry to the visa office that is processing your application. This is the correct communication path. Optionally, you can email them as well.

As much as you don't believe you commited fraud, you did intentional withhold information that your marriage is failing before landing and had every opportunity to withdraw your ex from your PR apllication. But instead you intend to go ahead and land as married so that your ex spouse can get PR that she was not entitled to get. Otherwise why did you wait until AFTER you both land as PR to divorce instead of beforehand.

Anyway, that is in the past and done. However expect your new PR sponsorship for both your new wife and kid to be put under a microscope. They may likely suspect that you and your ex collaborated so both get PR and divorced after landing on purpose with the intention of sponsoring future spouses. They will see that you both got divorced shortly after landing and that is a huge red flag.

Hmmm not sure if this is true (that this is necessarily fraud). A marriage can be falling apart for years but then the couple go for counselling and save it. In fact, it's probably a sign that the marriage is genuine & real, with real problems and challenges and not just an agreement on paper. Now, the situation would be different if they were, say, legally separated (is there such a thing in OP's home country's legal system?).

Of course a divorce following landing immediately is a huge red flag.

Let's look to the other side of things: applications take so long that people's circumstances change significantly. Assuming genuine intents, maybe they decide to stay together for an *INDEFINITE* amount of time (not permanent, just indefinite, as in with no plan to end the marriage) when they land....then it's legit. That means no sponsoring someone though. If OP remarries in Canada then doesn't really matter, no fraud. If OP wants to sponsor someone, it will take something like 5-10 years before they can do that (I have zero info on that, please fact-check). If OP really wants to sponsor the new family....then that's the person they should add to the application.

Sorry to hear of your troubles, OP. I think the bottom line is, you cannot sponsor more than one spouse within the same "frame of time"...you have to choose one. Depending on your circumstances, you probably can add kids from both families....but you have to choose one spouse, with whom to actually live right now.

Not immediately though....after years and years....but also that's the whole point...life changes a lot in years..40yr old you is very different from 30yr old you.
 
*If* they're doing it for their kids...Maybe the right (i.e. legal and also moral) thing to do is to sponsor only the kids and later she can come with the real intent of taking care of Canadian kids? (i.e. her application would be based on the kids and not the ex-husband). I don't know if there's such a care-giver visa for minor PRs/Canadians.

The OP admitted that they were considering fraud and also that they are doing it to not miss out on PR. I don't think their original plan was fraud but you are supposed to notify IRCC of any breakdown in the relationship and their desire to withhold that information is the issue.

Wow I actually never knew that you need to report intent...interesting...I should say I never even applied for PR so please do not take anything I say as more than a very uninformed impression. Follow the more veteran users instead.

I gotta say I find it weird that IRCC want not only facts but intents...like, if the marriage is in trouble right now...what if they go to counselling then they save it after all? I mean, can we arrest someone for thinking about a crime before they even do it?
