I am citizen of India, Indian passport holder, doing my Masters in Australia and currently on legal study visa / student permit.
I am willing to marry a boy who is Canadian Citizen, Canadian Passport holder.
Both of us were previously married in India and now legally divorced. We both have legal divorce decree from the Indian court for our earlier marriage.
My fiancé who is Canadian Citizen, living there since last 20 years has No Criminal Records in Canada but his previous wife filed FAKE CASES of Domestic Violence on him in India to extort money and has a India Court Order for some outstanding Alimony money to be paid to his previous wife. He was never been informed by legal authorities in India about Fake Cases & couldn’t put his side of facts for the fake case on him. His previous wife has no legal status in Canada, never landed in Canada, she is Indian citizen and Indian passport holder. My fiancee did his previous wife's Spousal VISA sponsorship but application was withdrawn by him before Canadian immigration made any decision on Spousal VISA sponsorship application. He doesn't have any sort of outstanding court order from Canadian Court or never defaulted for Canadian immigration spousal sponsorship terms and conditions.
We are planning to get married here in Melbourne Australia and get all marriage related paper work done in Australia. He is going to file an application for Canadian Spousal VISA Sponsorship for me. Can he be eligible to sponsor spouse with some Fake Cases and pending Alimony court order of Indian Court?
