Hi everyone

I was an International student and get immigrated (PR) by spousal sponsorship in canada after my husband and I were married.
Me and my husband married 5 years now, and we were separated (with signed agreement) almost one year. Now when I ask him to sign the divorce paper, he asked me to give up my PR or he will not sign it. I probably will go see attorney regarding divorce advice. but I am wondering if he is able to do anything regarding my PR? such as revoke.

Thanks in advance.

No if you landed and were married at that time in a genuine relationship he can’t do anything about your PR status. You won’t be able to sponsor anyone else for 5 years from your landing though.

If you've been separated for a year he doesn't have to sign. I got divorced last year and you just have to prove it was served legally. If he chooses not to respond you can get it granted on him not responding. It takes a little longer. But he can't threaten you with your PR. If you have that in writing include that with your divorce papers. It took me about 4 months total and I was divorced. No lawyer. Did it by myself.

Divorce in Canada doesn’t require both parties signatures. The court decides and won’t delay processing because one party won’t sign. If you’ve got proof of the threats he’s making, submit them to the court as well.
There is nothing he can do to prevent the divorce from happening and nothing you need to worry about.
