My husband and I have mutually agreed on getting a divorce. I have been in Canada for the last 5 years and he is in India and we have been married for last 3 years.
I am going to create a candidate profile under Express Entry - Canadian Experience Class and I asked him if he can wait for a couple of months before we actually file for the divorce but he doesn't want to wait and he wants to start the proceedings right now, but I am scared that if I start the proceedings now then it might affect my application.
What should I do?

What should I do?
Definitely start the legal paperwork for the divorce process asap. This will make life much easier for you later when IRCC asks for proof that you are in fact separated / in the process of divorcing. It makes no sense to wait.

But in the forms there are no options to state whether I am in the process of divorce or not. The options available are: Married, Single, Seperated/Divorced.
I am just loosing my mind now.

Confirm if "separated" applies to you, I am not sure.

Say separated / divorced. Get the divorce paperwork filed as soon as you can. By the time you get an invite through CEC, hopefully you'll have paperwork to show the divorce has been officially filed with the courts.

The lawyer in India said it will take about a year to get the divorce decree

1. It doesn't effect your application, because obviously you won't be including him..
2. Until you are divorced, or can convince CIC that you are separated, he will will require a background check meds etc..

I am thinking of applying him as an accompanying spouse. Is that what I need to do if I state that we are in the process of getting a divorce?
