Divorce in process while PR CEC 2016

Hello friends,

I am cec inland applicant with CEC PR application currently in process.

Initially when I applied for PR my wife didnt want to come to Canada. Since I work here I asked her to become PR together, but she refused so I put my wife as non-accompanying and did medicals before the submission of the PR application. She wanted me to move to my home country.

Currently we are going through a rough patch and she asked for divorce so the divorce case is currently going on in the court for the past two months.

I was not planning to tell CIC about it since she is not accompanying and thought PR would have been processed by that time. Now CIC is asking for her medicals as they are about to expire, but she would not do the medicals.

My question is how can I inform CIC about the situation, we are not legally seperated and I am not divorced , what should I do next.

Sorry to hear about your marriage. In your case, you would probably benefit from finding a Canadian immigration lawyer to assist you in making your case to the IRCC.

How long will it take for a divorce to be finalized in your country? Are you contesting it or is it relatively simple?

If it takes a LONG time in your country, and you are not contesting it, you could also file for divorce in Canada (even though she is not here), it possibly would be finalized more quickly.

Assuming you have a lawyer in your home country, you could also ask them to prepare an affidavit that your (ex-)wife would sign, stating that she refuses to undergo another medical exam, no longer desires to be part of your application, and understands that she can never be sponsored by you for family class PR in the future.

Barring that, you would of course inform IRCC about the pending divorce, include copies of the court documents to prove that it is in process - worst case scenario is that they make you wait until the divorce is finalized.

All of this is very tricky. As I said in the beginning, you will likely need a Canadian lawyer to help you with this.

That's not too bad, if it doesn't take too much longer. You could inform IRCC about the pending divorce, provide proof, and request an extension until the divorce is finalized.

Somebody told me that from my home country this is usually finalized very early, around in a month too if woman ask for divorce.

Thank you Jes_ON for your reply. I will send CSE to IRCC that my martial status may change, as court proceeding is in order. I am not sure if this will impact in anyway my immigration to Canada.

I became PR in June. I hope this post will help anyone who needs it.
At the time, I informed IRCC about the status of my marriage as it was getting unstable with court proceeding. They asked me to give them the documents from court proceedings and deadline at which the Divorce will be finalized. With my country it takes around 4 months , so I asked them 4 months period, and told them a specific date at which I will be able to get the divorce certificate and IRCC was helpful. IRCC updated my file with a request to Divorce Certificate with a deadline of 4 months. There was no update for 4 months from IRCC and I believe my security clearance was getting finalized. As soon I received the divorce certificate, I uploaded the file and PR was finalized after a week with request for passport.
