Divorce & CEC urgent Advise needed

Hello All,

I know this might be a stupid question but I need to assure Iam doing the right thing.

I got married on April 19 2013 and applied for CEC few days later...I chose to apply under CEC and not go for sponsorship because I did not want to risk or be threatened in case of a divorce.

I received my PPR on may 14th 2014 and passport was received by CIC on the 20th and waiting for the return tracker to be activated.
I am planning to land right away when I receive the CoPR.

Unfortunately my Marriage is not going well and I want to get A divorce and I have been waiting until I land.

1-can I proceed with divorce once I land or do I have to wait until I receive my PR card?
2-is my status as PR will be impacted after divorce?
3- once I land and before receiving my PR card is there any possibility for CIC to re-open my file and change their decision and withdraw my status as PR.
4-how long do I have to wait after landing to file for divorce?

You are almost there ... I think it is best that you wait until you finish your landing and other formalities before you can start your divorce proceedings.

There have been other threads where people in `rocky marriage` situations have applied for their PR and have successfully received it. You may want to browse through them and contact some of those forum members if the need be.

i was just about to.get visa under family class but due to.some misunderstandings my partner withdraw file.. is there any chance to re open the file after requesting to cic..

You are an economic class applicant, not a family class. You you have been approved on the basis of meeting the CEC program requirements, not your family status. A change in family status (e.g. divorce) will have no impact on your PR status.

I agree with Hope, that it is better to wait until you land. But there is no set "waiting" time.

As for the possibility of CIC changing its decision, that would only happen if it were determined that there was a misrepresentation on your application, and that you had obtained your status through fraud.
