Divorce as a sponsored person in Canda.

Hey,
My parents can't hear. My step dad took me, my mom and my brother to Canada and he sponsors us. He rushed the marriage and said everything will be ok. He visited our country twice and he was good person. Now when we arrived after not even one year of living with him he's totally different person. He doesn't want to create a good and happy family. It's very hard to communicate with him and he's drinking. My mom is thinking about divorce and I'm trying to help her. We all have PR cards and all that stuff. How it looks like? How can we get some free law aid or something like that? We feel cheated by him so much... Where can We go?

The sponsor person is responsible to support the sponsored family member for 3 years in your case. Lately under the immigration regulation, all new immigrants that have got married less than 2 years without children issued a Temp P.R.. Do you , your mother and brother are all holding that Temp P.R.? if so that will be some problems... otherwise, as long as you, your mother and brother are not applying social help will be totally fine!!

Actually, first of all, one of you three need to have a job to support regular life before really filing some divorce paper. In most of the Province in Canada, a couple need to be separated at least one year to file divorce, what you need to do is finding a divorce and immigration lawyer to consult then move to next step.

Thank You for reply. Me and My mom are working. We have normal PR cards. I don't think We have temporary. How does it look like with finding home? Does government helps and gives a home for alone moms with one son (my brother is 13 years old) or We just have to find condo or house for rent by ourselves?

You need to find a condo or house to rent by yourselves.

Canada does have social (government assisted) housing programs. However the wait times to get into these programs is around 10 years in most places.

Your situation is really not an immigration issue - it's a family law issue.

Most cities have community clinics where you can get some basic legal information / advice for free. Google the name of your city + "community services".
