Dispute between ICCRC retainer and the agent

I am writing to seek guidance related to a dispute between my retainer and his agent; who is helping me with filing an express entry application.


Recently, I received an email from the retainer, with whom I have a formal retainer-ship agreement, that his relationship with the agent (my direct interface) has strained and, that he is taking a legal action against the agent for terminating their MOU. In the email he has encouraged me to stick around with him, since he is legally bound to pursue my EE application.

However, the agent has asked me to sign a user representative letter so he could now associate me with a new retainer, although I am not aware of its legality.

Please let me know how to proceed further. Should I stay with the current retainer, with whom I have the agreement (signed with the help of the agent) OR continue with the agent by signing the user representative form and move on with the new retainer. Please suggest.

If I understand correctly. You signed and agreements with an agent who represent and ICCRC member?

If they are having dispute I think RCIC should be able to continue your application as your agreement is with RCIC. Agent was the middle man representing RCIC to seek clients.

Agent isnt authorized to give advise and represent you.

You are correct, the legal agreement is between me and the RCIC, so, it makes sense to keep the communication with him. However, the local agent is the one that holds all the documentation and he is the recipient of payments made and he is the one who's filed EE application. So, I've been confused now for a while.

Also, the agent is willing to associate me with a new RCIC and therefore, I am not sure if I should stick with the current RCIC or move on with the new RCIC

You need to look at the legal documentS you signed. You may not have an option to move without paying the consultant or you may get sued if you move and don’t pay the consultant.

If agent filled application. He has been doing it wrong. Agents arent allowed to give any advice for file application. If you have your receipts of payment made. You RCIC is obliged to honour them as agent was appointed by him. Hope this helps

I have reviewed the legal agreement and notice the payment is already made, for his services in phase 1- creation of EE profile. Phase-2 payment is due only after receiving ITA.
