Discarded from PR after the invitation, despite I had the same requirements

In few words, this year I had a profile on CIC website for Express Entry.

I entered the pool for my skilled experience abroad, my English tests, bachelor degree and so on. Having had a skilled LMO here in Canada gave me additional points that granted me an invitation to apply.

In my profile it was clear that I was not working for that employer any more, since I left for serious problems at work.
My reason was judged as a good reason from Service Canada, but in the beginning they denied EI benefits because I was with a Work Permit. After a lawyer wrote a letter for me, they gave me back EI benefits.

Now my situation is the same that I described in my profile before getting my invitation to apply but they have rejected my application because I am not working for that employer without asking any clarification.
(It was not written anywhere that you need to keep working for them since you will get those LMO points also if you are applying from abroad and you are not working in Canada yet).

Before leaving Canada I would like at least to understand if there is anything I can do. Your opinions would help.

Best regards,

The points for the job offer absolutely need to be for your current job. If you left, regardless of the reason, you are no longer eligible for the 600 points.

I second it:

Sorry to hear your refusal.

Okay, so why did the invite me when they already knew from my profile that I was not working there? ???
It makes no sense and costed me a bunch of dollars as well, for my wife and I.

Are the job offer and LMO valid also for people that are still abroad?

They gave you an invite based on the assumption that you would be working at the same place that you were claiming the points from. The system can't check it for you, they rely on you entering accurate information which they then check post ITA. If it doesn't match, they will then reject.

For the people still abroad, the job offer and LMIA are valid. They will begin working for the company once the PR is issued.

You were invited based on your total points. You shouldn't have claimed job offer points if you were no longer working for the employer. That should have been obvious to you. The error that cost you money was entirely yours - not CIC's.

Sorry to hear that mate ... but i would say dont loose hope i have seen many cases in this forum where the candidate got PR after multiple refusals .... i would suggest you to create a new profile and enter in to pool ...if you have more than 400 points you will get ON PNP invitation (processing time approx 3 months) and this will give you 600 points and then you will get the invite ....
If in case if you are in 460-470 then you will get the invite .... and the start fresh...
I have seen the examples where just after refusal ppl applied fresh and get the PPR with 10- 15 days ..... All the best !!!

Thanks bud, not sure what I am going to do right now...

Biggest concern is that I don't trust this system so much, when I got my invitation with all the scores, they did not count any points for Canadian work experience (for my wife and I) despite we both had at that time 2+ years of legal working in Canada.

Do you know how many points you will need in AB?

Can you please elaborate on this point. I have over 1 year working in Canada in my field and have the letter etc. and am now worried. I am also providing tax returns, paylsips, T4s, employment contracts, job ads.

Am I in danger of them not counting my experience as well?

I think he means that his points for experience were not included in his CRS score prior to the ITA.

Exactly, over 2 years of legal work in Canada, scored me and my wife 0 points on the summarization paper you get together with your invitation.

If they did not count these point, there is a chance I can qualify even without the 600 of the job offer...

What NOC was the Canadian experience in?

And have you tried to update and resubmit the work experience portion? I made a change to mine once which dropped off the experience, made another change elsewhere in my profile and when that updated, the experience points came back again. So essentially a bit of a glitch worked itself out.

I don't know if it would make any difference, but calculate what your CRS was without the 600 and compare it to the draw number for which you received the ITA. Would you still have earned the ITA? If this is an obvious error that CIC did not count your work experience then it should be part of your CSE.
