Difference in wages between LMO and offer

I am going to apply for extension of my Work Permit. During period between when LMO was requested and LMO was issued my base salary slightly increased. So now my salary 5% higher than in LMO confirmation. Since I am going to apply for WP extension now, work offer is issued for new base salary.

Question: Will I have any problems with such difference between LMO wage and offer wage? What you can recommend to do in this case?

No, as long as the wages are not lower than what was approved on the LMO.

I attended the LSUC immigration conference at the end of Nov. SC was there talking about the new rules, particularly STS (substantially the same). Said that SC would allow a 2% differential (higher or lower) in wages and that if the wage increases more than that, the job needs to be re-advertised because Canadians may have wanted to apply with an increased wage. I don't know what CPC-V is doing about this with higher wages as I've never seen one refused with these circumstances. But I am hearing about more STS audits for employers.

To the OP, don't want to scare you as it will probably have no impact on you in particular unless SC decides to do an audit and pulls the LMO. Chances of that are probably slim.

I don't think CIC will reject your work permit application. It's a Service Canada thing I was commenting on. Basically, Service Canada is saying that your 5% increase in wages require that the employer apply for another LMO reflecting the higher wages. It's a bit complicated and I sincerely doubt that CIC is going to report the higher wages to Service Canada to trigger either an audit or withdrawal of the LMO. But to be safe, your employer might want to lay the groundwork for a new LMO application should it become necessary. Apply for the WP extension with what you have. Truly the best advice would be for your employer to apply for a new LMO reflecting the higher wage but you may not have enough time left on your WP to await the result.
