Hi guys,

Please help me...
Today I just got my application back.. (OWP.. I applied this when I applied my PR as a spousal sponsorship)
Here is the story.

1. I applied PR and OWP before my previous wp expires. So I was on implied status currently and I have been working.
2. I didn't get any AOR until now. (CIC received my app on 23rd September 2015)
3. Today I got my OWP application back (Only IMM5710.. and receipt. no other document) with letter says that I didn't pay 100$ for OWP holder fee so I need to pay and I can resubmit with the receipt as follows:
'You have submitted $155.00 with your application. The correct amount required is 255.00 for the services you requested. We cannot take any action in your case until such time as you resubmit your entire application with a copy of this letter.
4. However, In the letter, It also says that:
'We also wish to advise you that your temporary resident status expired on February 3rd, 2016.' 'You may apply for restoration if, within 90 days from the expiry of your temporary resident status blabla'

But this letter already contains application number (Starts with W) and my IMM5710 document has the stamp of the received date and sticker which has the application number and UCI.
So I am wondering if this means that cic is still holding my case and waiting for the rest of 100$ so they can continue the progress?
If it's this case, will I be able to keep my 'Implied status' and keep working?
Can I resend this IMM5710 back with just additional receipt? or need to apply for restoring anyways?

OR

Does it mean that they refused all the progress so I won't be on Implied status?

Please let me know.
Feel so depressed and I kinda have to work since my partner is still a student..

Hi

You are currently out of status and don't have Implied Status. You need to immediately stop working.

You must apply for Restoration. This will take several months to process and you cannot work at all during that time.

Also, given that having status is a condition of being granted a pilot program OWP and you are now out of status, it's possible that CIC will not restore your status to worker by granting you the OWP.

1. You are no longer on implied status and must stop work.
2. You now have to apply for restoration and a new work permit not just send in the old one.

I am a bit confused. So that means, it is possible to refuse my restoration again?

Since I am married with Canadian citizen and already submitted Inlnad PR Application, (No AOR yet. Submitted on Sep 23rd 2015), doesn't that mean I can have OWP anyways?
Also, Is it possible to get removed eventhough I already applied for inland PR application?

Sorry, just going to jump in here, I do feel terrible for you.

You unfortunately won't be able to get OWP because having a valid status is one of the requirement to apply for OWP under the extended pilot program. Otherwise you'll have to wait until AIP, and since you don't have your AOR yet, it will be a while.

I don't think you'll get a removal order though, you can apply for PR without having a status after all. They may not restore your status, but you likely will not get a removal order.

You no longer have valid status, a requirement to be granted the OWP, so they may refuse it. There are others in your situation and until someone confirms that they were granted restoration and the OWP along with it, no one can say for sure how CIC will handle the situation.

The chances of being removed are very low.

Things got changed a bit.
I found out that my PR application is under progress now and they even sent me the email that asking to apply CSQ with it. (I am Montreal residence) Since Jan 28th so it's even before they sent me the work permit refusal mail.
It was in my spam inbox somehow so I didn't know that.. I am going to apply for CSQ tomorrow.

So what I did is that
I gathered all needed document again and put the letter of explanation, and attached the letter (which the one asks to obtain CSQ with it. It has my file number UCI for PR app)
and paid 100$ additional fee + 200$ for restoration. Of course attached the receipt.

I am going to send this document tomorrow.
Do you think CIC will accept it?

I stopped working immediately as soon as I got my application back.
