Did not change condition on WP, LMO rejected ...

Help,

I did not change condition when I changed employer but new employer filed for LMO while working for him, but got rejected. Still working for him and now he tried PNP. If PNP doesn't work again what can possible things will happen? I will stop working for sure, then can I re apply for new LMO elsewhere without leaving Canada? My TRV is still good until April 2010. Can I just stop working without restoring it to TRV, or do I need to cancel WP? Please help

Are you on an open work permit? If not, then you are currently working illegally and should better hope they don't catch you or you will be in big trouble.

When you are on a work permit that is tied on an employer, that means that you can not work for any other employer. If you want to change employers, you need a new LMO from that employer and a new work permit.

You can ask why the LMO was denied. If it is something simple like not having advertised the job for long enough, not offering market wage etc., it would be easy to fix that and apply again. If the problem is that he can't really prove your expertise and that he can't get Canadian employees for this job, it would be a lot harder.

He can apply for your PNP with a job offer and there is no reason why that shouldn't work but it takes at least several months for you to get the PR and in the meantime you can not work for him if you don't have a valid work permit. If you get through the nomination stage with the PNP, you can ask them if they can help you get a work permit without needing an LMO.

You are allowed to stay in Canada at least until your work permit expires without changing your conditions, even though you are not working for that employer anymore.

Thank you so much for enlightening me. So my employer has to request for the WP based on the PNP approval right? And the PNP approval will suffice as support for the new Work Permit. Did I get it right?

You can ask the PNP if after you get your nomination, you can get a work permit without needing an LMO. I have heard that the PNP's can do this but I have really no concrete information on it. If they say no, then you will have to wait until your PR comes through.

If you get a PNP certificate (based on employment stream), the Province will issue a facilitation letter which allows to apply for a work permit without an LMO>
