Spousal is easier because you don't have to prove that you have been living at the same address for at least 12 months.

You still have to prove that your relationship is genuine and ongoing, but there's no requirement to prove 12 consecutive months of cohabitation.

So just to make it clear

I will head home mid june most likely
Simon will follow most likely mid august on a visitors visa
We will file for either a common law visa ( going off of previous 18 month stint of living together- not including the time on his visitors visa, for safety) or a spousal visa.
All this can be done with him in canada on a visitors visa? His home address will be back in New Zealand on all the forms, and he will return if need be, we just want to make sure we are not shooting ourselves in the foot by having him visiting while we apply

yes, the outland application can be sent in while simon is in canada as a visitor.

i believe he can even put your canadian address on his forms as the best way to reach him if he will be there for the majority of the process. since he has legal status as a visitor, it will not mean he is living there, just that's where CIC can find him when they need to.

Okay perfect, also I know he can do his medicals anywhere in the world as long as it is done by the certain doctor. Is it fine for him to file for his police records and so on from canada as well? Shouldn't be an issue should it?

he will not need a police record from canada, only any other country he's lived more than 6 mo. so i'm guessing NZ and Australia. I'm sure you can apply for them from anywhere, it just depends on how each country does it and whether they will send the results to him in Canada.

Does anyone know how instant a withdrawal of an application is? And weather or not you get your application package back?

actually i learned from this forum that applicants do NOT need police records from canada, even if they did live there for more than 6 mo. CIC will do their own background checks. Applying for one yourself is not needed and the wait time will cause an unnecessary delay in sending in the application.
