Desperately Need help with thiss!!! ?????

Hello i have questions, to start off i would like to tell about my situation, I met my husband in 2010, he was here in canada as a refugee, but was turned down, we took off to montreal, and then he was later deported in July 2011, and in August 2011, i flew out to mexico to continue our relationship, i was living in mexico since 2011, and in that time frame we got married in October 2011, we had our first child in September 2012, then when i got pregnant with my second child, i returned to canada when i was 5 months pregnant, when i returned to Canada, i moved with my parents, i went on welfare since i was not planning to start my hsuband papers until after our daughter was born, and i called immigration and they said that is wouldnt effect me, and that i did not need to meet min. requirements to sponsor my husband, but i am being told other wise but others, i am now wanting to start my husband papers, i am not working since my daughter is 5 months and my son 18 months, and i am still on welfare tho i am getting off of it april 1st, and i was wondering if someone could tell me the honest truth if this is going to effect me or how exactly is it to sponsor a spouse??

a few questions i have is,

what is the min requirments?
and i was just wondering if someone could give me there email or facebook, that way i could talk to them when ever i have a question about the paper work, because i really do not understand it, and i want to get the papers done correctly. please and thank you

It's not written on their website, but one of the requirements of a sponsor (that would be you), cannot be on welfare for the past 12 months from the date they apply for sponsorship. If you're getting off it on April 1 this year, then unfortunately, you will have to wait till April 1, 2015 to sponsor. The way its worded on CIC website makes it seem like you cannot be currently on welfare, but the truth is, they check the sponsor's history for the past 12 months

I have seen you state this many times on various forum posts. Do you have clear documented evidence that this is in fact the case? Because CIC requests your Option C printout does not mean that they will in fact deny you to be a sponsor if you had been on welfare in the previous 12 months. It only means they are in fact ensuring that you are not now CURRENTLY on welfare. So, while you might very well be correct, I have yet to see a post on this forum that a sponsor was rejected due to getting welfare in the past 12 months if they are currently working and earning.

Just a thought. If you are going to tell folks this with a matter of fact tone, then you should have the 'evidence' to back this information up. I can't find anything anywhere that states it is in regards to the previous 12 months, not just currently.

I called CIC agent twice about this, they said they look at the past twelve months to see if you've received welfare. Two different agents. It's not on their website, if you want, you can phone them yourself and see.

No, I don't need to call them. I would take anything the call center agents say with a grain of salt though as they are not known for their ability to give a clear correct answer when presented with questions. So, if you are basing your responses on this, then I would clarify that and let folks know you are basing it on answers from the CIC call center and not previous cases or personal knowledge.

I'm not trying to pick a fight, only to try and help folks to determine the best course of action for themselves.

My advice to the OP would be to get off of welfare ASAP if you wish to sponsor your spouse, because the fact remains that you can NOT be receiving welfare currently and be approved as a sponsor. That is represented on this forum by denials of sponsorship based on current welfare receipt.

Wow.... I hope it doesn't go by the past 12 months..... I got off in July and applied in October.... right now, they are requesting more info about hubby's work history and have said nothing about welfare.

The law about sponsors not being allowed to receive social assistance, is covered under Regulation R133: http://laws-lois.justice.gc.ca/eng/regulations/sor-2002-227/page-57.html#docCont

The only thing about social assistance it states is:
133. (1) A sponsorship application shall only be approved by an officer if, on the day on which the application was filed and from that day until the day a decision is made with respect to the application, there is evidence that the sponsor
- (k) is not in receipt of social assistance for a reason other than disability.


There is absolutely nothing about receiving social assistance previously or in the past 12 months. The only law is that you can't be receiving it as of the day the application is submitted. If you have been receiving assistance in the past 12 months, then most likely the visa officer will want to investigate more to ensure you weren't receiving it when the app was sent. So should include some kind of documentation that clearly shows the specific date the payments stopped.

Any call centre agents who tell you that you must have stopped receiving assistance for full 12 months before you apply, are wrong.

My fiance receives Goods and Services Tax and Harmonized Sales Tax every 3 months (I think), is this considered social assistance?

And the Visa officer will look closely as to how you will support your spouse, if you claimed welfare in the past, especially if your sponsored spouse doesn't speak English/French and has no transferable skills.
