I'm not in trouble but my wife could be. She is illegal here and we are trying to take steps to get her legal. Would it be wise to apply for common-law sponsorship myself or get a lawyer? Can anyone tell me how difficult it is to get the paperwork all together? And basically was wondering what happens when someone receives a removal order?

the paperwork is not difficult but I dont want u to spend ur $ on a lawyer if they cant make her stay here if there was a deportation order bcuz the process cost enough as it is and u may have to apply for an ARC which is another fee so thats my $0.02

Hello guys, you have to think about it , it is a really hard situation, for example i would like to share my experience with you guys, when i was in Canada i applied for refugee claim, however my case was refused and i left Canada on time when they requested me because i wanted to avoid problems like deportation, in that time i met my husband and now he is sponsoring me , we applied for family sponsorship in April, my VO has requested me some documents and i sent them already , when my husband and me filled up the sponsorship documents we wrote i got deportation order that was the reason i left Canada but it was a big mistake because i got departure order and no deportation we did not the difference anyway now my VO is requesting me an Authorization to Return to Canada I made this payments and i sent them all the documents as prove i complied with the law in Canada and i did not get any deportation, people said it is very hard to get this authorization i hope everything is gonna be ok , few days after when i sent my payment and a letter with the reasons why i want to return to Canada , my Vo emailed me requesting me documents where they can see why refugee service refused my refugee case, I am scared maybe they will take a decision based in my refugee case and they dont see i have another reason my HUSBAND i am worried i need your advices!!!!

Basically you can apply to sponsor her, if only the removal order has not been issue yet but if it is already been issue you mean't want to apply for ARc immediately then file for sponsor with every proof and since you said she is wife it will be better to apply as married couple not sure about common law stuff. Note: If she has never been given a removal letter then you can still file as long has she is out of trouble until the process is completed. If i'm missing something, someone here can tell you more!! A deportation order would be the result of criminal inadmissibility or not departing within 30 days of a departure order coming into force. Otherwise the order is an exclusion order for working or stuyding without authorization or overstaying a visa. Timelines for requirement of being outside Canada if ordered depend on the type of order.

It would very much depend on the details of the situation to know if something could be done about the situation in Canada to legalize status or if departing is the best option and resolving the situation from outside Canada. It could be very costly in Canada and not necessarily successful.

If no enforcement action has taken place at this point the route with the least headache is likely to depart and sort out from outside Canada and not have all the added complication that will come with removal.

I got a departure order for overstay 10 years ago, we are still going through the process, but Im now in Canada on a year long vistor visa.

Wow 10yrs is a long time. Anyways how long did you stay before you got your visitor Visa? Did you leave immoderately after you got the departure letter and what is the best way to get her back on track....Your input will help alot..

Hi MandyUK, i have a question for you did you apply for ARC??? When i got departure order I left Canada within 30 days I dont understand why they are requesting ARC , an officer verifyed my departure at the airport , maybe i confused my Visa Office when i filled up the sponsorhip application when I wrote i got deportation and no departure, now i am worried what can i do???

I need some idea about admissibility hearing. I was caught in myemployers business working. My employer is my husband. He hired me to look after his kids from his ex common law partner. At that time they are processing for a separation in court and waiting for children custody decision. From january he start processing my paper under live in caregiver. During those time up to december which i recieved my work permit we develop our feeling to each other then leads me being pregnant for my first child. While i am on work permit under his name i was looking after his kids whenever they are in our house and i am getting paid monthly for my services. In my spare time i was working in my employers business.until they caught me there. At the time they caught me i was 7 month pregnant on my 2 child. They took me in cic office and interview me. They ask me to report evry 1 wednesday of the month they told me they will process my case after my child birth and at the same time they ask my husband he can sponsor me under spouse or commonlaw. Me and my husband got married on september 1 and baby born on sept 5 i pass my application under commonlaw as im so worried they will send me back home. As of today i went to report and they told me they will contact me for my inadmissibility hearing. Help me what im going to do

Yaz, when you left Canada you should have signed a form at the airport to verify your departure and received a copy of it. On that form which is a 0056 it would indicate if your order was a departure order, a departure order that became a deportation order or an exclusion order. The information on the form would be entered into the cic system and available to be seen by the VO.

You say you left within 30 days, but it is important within 30 days of what. That 30 days means from the time of the negative refugee decision coming into force not when given a direction to report for removal.

NBaker I did it, I signed this form and i received a copy, but this copy says departure order becames to deportation, whyyy??? i did not overstayed cic gave me a date to leave Canada and i did it before they never notified me leave, i really dont understand , maybe the officer at the airport made a mistake , nobody forced me, i bought my ticket everything was fine, i dont understand what is happening..
