Dependent spouse TRV rejected

Hi Gurus,

Please guide me on the following situation..

I am on work permit and my work permit is valid till end of aug '08. We got married in june and my spouse applied for TRV as my dependent but the application got rejected.. (officer not convinced that my spouse will leave at the end of TRV)

I am going to apply for my work permit extension.. Could I add spouse name to my extension application?? If my work permit gets extended, how fair are the chances of my spouse getting TRV??

Hi Bramyah,
If you have gotten your extension, I think you can apply for your spouse under spousal program but not as TRV. The CIC could grant your spouse an open working permit ang her/his visa will depend on yours.
You can try browsing the CIC website and click working in Canada and you'll get the information on how to get your spouse while you are in a WP. This is the website...www.cic.gc.ca

I heard this is only applicable for Spouses of Skiller Workers (Noc Categories that fall in Skill level O, A and B.)

Yes, only holders of TWP with skill levels A,B or O is the spouse eligible for an open work permit.

Hi,

If TRV rejected twice, then open workpermit chances are low?

my husband is on Workpermit and it is valid upto march 2013, my trv rejected twice..if i apply for open workpermit now...will the chances are low

As PMM's reply says, your husband's job must be either skill levels A or B or skill type O for you(as his spouse) to qualify for an open work permit.
Without knowing why your first two applications were refused, chances are you still have yet to overcome whatever concerns the visa officer(s) had and another application for temporary status would likely fail for similar reasons.

You should apply for your caips/GCMS notes - these contain comments by visa officers and should provide more information as to why the applications were rejected. Your husband can do this on your behalf(being in Canada) for a $5 fee. He completes this one on your behalf: http://www.cic.gc.ca/english/pdf/kits/forms/IMM5563E.pdf and you complete this one: http://www.cic.gc.ca/english/pdf/kits/forms/IMM5475E.pdf (to authorize CIC to release the information to him).

My husband fall under A,O,B category level. my trv rejected stating that, i would not leave the canada after trv expires,family ties in canada... two times same reasons..evethough we provided every information. now we are planning to apply for open workpermit. but how are the chances...

When applying for a TRV you have to show strong ties to your home country. With your husband in Canada(family ties), they were concerned you won't leave especially if you don't have dependent children back at home that need you. I don't know the chances but you can try and see how it goes.

strong ties to my home country means..what should i show....can u pls suggest various options here...
... to believe them i would return my home country

If you have small children that need you or even aging/sick parents that have depended on you for some time, that can convince them you will return to take care of them. Think of things you will return for and provide evidence. Do you own properties that you have to manage? Are you employed and is the employer willing to give you a letter?

I got married recently last year may 2011, its been an yr i met my husband
I dont have children...i am working as a senior software engineer in hyderabad. but what kind of letter my employer should give me...
Own property means.. can i show fixed deposit...if yes..how much should i show....

If your employer can give you a letter saying you have been granted permission for a specified amount of time to visit your husband(a vacation) and they expect you back after, that could help. If you had kids that would have been ideal. By properties, I mean a house, business, etc that you own and manage.

Last time for TRV we provided a letter saying that my company is granted me 4 months leave...after expiry of leave i would be joining ....
even then they have specified that...i would not return back to india...

now we are planning to apply for open workpermit... if i show a house of my name..will that be enough for me....

Is it better to apply for open workpermit..from hyderabad, or should i go to delhi to submit....for fast processing...pls if u have any other options pls tell me....

Hmm... you can certainly try for an open work permit. Re-applying so soon after a rejection and without a change in your circumstances(additional supporting documents), may produce the same outcome. But you won't know if you dont try. :D

As for which visa office to use, it depends which is more convenient for you and processing times. If you can get to New Delhi for an interview with no problems, you may use that office. Note that no matter which visa office, they can access your previous applications. :D
