Dependent child sponsorship - Impact of new rule - Please Please Help

Dear Leon,

I have asked some questions about my child , how to sponsor him.According to your kind response that there is no special income requirement to open a sponsorship file, I just want to ask ,if i immediately find a job in a store , or anywhere as a low level job (although i am educated) , with the salary of minimum 9-10 $/Hour , do you think it is reasonable to open a sponsorship file and then later try to find a proper job according to me special experience?

In addition, If first time, the sponsorship file being rejected because of the assessment of myself (like my low income as I explained in above paragraph) , does it decrease the chance for me to open a new file for the second time when i find later another proper job?

I would say any job will do. It is unlikely that you will be refused because of lack of funds but if you are, you can surely apply again when you have a better job.

thanks in advance for the previous complete responses.I just received a newsletter from "attorney David Cohen" with the following news about "dependent Children and new changes in rules" :

3. New Rules for Dependant Children Soon to Take Force
As a result of recent regulatory amendments, starting 1 August 2014 the Canadian government will redefine who can immigrate to Canada as a 'dependent child'. From that date onward, the definition of dependent children will be narrowed to individuals 19 years of age or younger. Currently, the age cutoff for dependent children is 21 years of age.

I just want to ask If you know I can still apply for my son as he was born on October 1995 . I do not know if I can apply to sponsor him yet. As I will be in Canada in September , I am worry this rule will be fixed.

Please advise .

According to http://www.cicnews.com/2014/07/rules-dependent-children-force-073549.html you must apply to sponsor him before he turns 19.

You should get the application ready and make sure you have all paperwork needed in order to send in your application as soon as you arrive in Canada. As long as the application is received by immigration before his 19th birthday, he can still be sponsored.

My question would be, the OP says she was recently "landed" as a PR. If her son was not included in her application as a dependent and examined, then she can't sponsor him.

CIC must receive his complete application BEFORE his birthday in October. Once his birthday comes and he turns 19, he is no longer a dependent.

Also make absolutely sure you send a COMPLETE and ACCURATE application. If there are any missing forms or documents, missed signature or something and they return the application package to you to re-do, he could lose his dependent status as you would need to re-apply after his birthday.

Poster already mentioned the child was declared in their own application but couldn't accompany to Canada, so that is no issue here.

Thanks for your explanations. Really that's too high risk for me to come there on september and want to open my child file before october ,to make ready all the certificates and so on.

I do not know IF this next question can be asked in this page . please dvise me If I should not ask that here.
I want just to know according to this rule, Canada Government announced the children older than 19 years old, should apply via student visa or investment visa.About student visa, I want to ask as my son just took entrance exam in IRAn for Bachelor degree ( he has finished his high school recently) , Please advise me If you know I can get student visa for him for bachelor level in canada university .Please advise If I should ask this question in the other pages.

In addition, the real problem of him that he could not get immigration visa with me at the same time from embassy was that , when the embassy sent me email to go to Ankara to get visa for us , he did not had his passport available because of some other reasons and then I had to land in canada and when his passport was ready , I tried to follow his case. Unfortunately just I asked via email from embassy how I can follow his visa, as his visa also was ready to be issued just not valid passport we had on that time, they responded that my file has been closed and I should apply via sponsorship and now that I want to apply via sponsorship , this new rule stopped me again . I am sorry to explain the whole story here , just I thought maybe you can advise me what I can do to get his PR in anyway later . If It's possible via study visa, OR you know anyone who can help me to follow the previous case ( although I do not know If it is worth to spend more time to follow that ) .please advise.

I don't see why you can't start working on the sponsorship application now, getting all the certificates together etc. Then you will have everything ready to apply when you arrive in Canada in September. Making sure you apply before his 19th birthday is really the simplest solution to making sure he gets his PR.

Another alternative is like you say, he applies for a study permit to study at a Canadian university. He will have to prove that he has enough funds and that he will not overstay in Canada. He will have to pay international tuition fees which are usually about 3 times higher than required for a PR or citizen. During his university, he can apply for an off campus work permit to work along side his studies or on breaks. After he graduates, he can apply for a post-grad work permit. This will allow him some options to apply for his own PR.

As for re-opening your old file, I do not know if that is an option. Maybe you can appeal it but as far as I know, it is your duty to provide the passports for stamping within the time limit they give you. At the time you could not provide his passport, did you inform them why you could not provide his passport within the time limit and by when you could provide it? Did you ask them to wait for you to provide his passport before issuing you and the rest of your family the PR visa?

Thanks again for complete explanation like always.As I 've heard and according to what yu said, maybe there is less chance for him to be able to get study visa later as we can not maybe convince the officer that he will come back afer finishing his study.I mean because I would live there too as a PR, so the embassy will get that there is no reason for him to come back and a lawyer told me It's possible that they do'nt give him study permit as I have a PR card.

for Sponsorship, the only my worry is that I should find even a simple job just to make sure that the officer will not reject my request for sposoring him. This is the only risk I will be involved that in about 1 month , I should find a job and as you know It is possible that I can not find .
Although I a m thinking to do this risk anyway , maybe come earlier to have more time .just when I found a simple job, let's say as a seller or cashier in a store, Do I need to get any letter from the manager of that working place, for e.g , the store?
and do you think any manager for such these places will give me the letter soon?

If you don't have time to find a job before you must apply for him, then apply without a job. As for your funds, show your bank statement and state that as you have just arrived in Canada, you are looking for a job and will update them later. That way, you have a chance. If you don't apply before he is 19, you lose that chance.

If you have found a job before you apply, you can ask the employer for a bank letter, just a letter saying when you started and how much you make. They should give you one. If not, send your last pay slip as proof.
