Hi there,

I am an Iranian mechanical engineer, and now I am ready to send all my forms for starting immigration progress. However, I am in doubt about one part in Generic Application Form. I got divorce my wife about a year ago, also I have the full custody of my daughter who is 8. Because of some reasons, I would like to take my mother with ourselves for some helps about my daughter.

In dependant part of Generic Application form, I choose "Yes" for question number 11 (Will accompany principal applicant to Canada?) when I was filling my mother information. But I don't know what kind of "Dependant Type" I should choose for her.

It would be appreciated if you help me to do this. Also, If there is any subtle point to know, please let me know.

Unfortunately your mother cannot be included as your dependant.
For immigration purporses CIC doesn't treat either parents and siblings as applicant's family members. Only spouse and children can be included.

To back up what arika has said, your mother is not a dependent and cannot be included in your application. If your mother wants to immigrate to Canada, she will have to qualify independently. Or you can sponsor her once you have worked in Canada for at least three years and meet the minimum income requirements for at least three years in a row.

Please let me know how can I add my new spouse, after I send the application and documents? I mean what should I do for getting visa for my new spouse when my file is in progress? How much does it take? Can I take my new spouse with ourselves to Canada?

If you have already re-married then you must include your new spouse in your application. Your spouse will receive a PR visa at the same time as you do.

If you remarry while your PR is being processed, then you must add your new spouse to your application before you come to Canada. Your spouse will receive a PR visa at the same time as you do.

If you get married after you become a PR, then you will have to sponsor your spouse through the spousal sponsorship process. This can take anywhere from a few months to a few years.

Your mother can certainly try applying for a visitor visa. To be approved, she will need to demonstrate that she is a genuine visitor to Canada, has ties to her home country, and has no plans on remaining in Canada long term. If she is granted a visitor visa, how long she is allowed to stay will be determined by the immigration officer she speak to when she arrives in Canada. Typically visitors are allowed a six month visit - but it's entirely possible to only be given a shorter period of time. She can apply to extend her visit once she is in Canada - however it is impossible for any of us to say if that extension will be approved - and sooner or later she will have to return home.

If you want her to remain in Canada as a visitor for a longer period of time, you can apply for a super visa. However you don't qualify to apply for a super visa now. To qualify, you'll first have to come to Canada and get a job here where you are making a minimum amount of income required to sponsor your mother for the super visa. Once again, to be approved, your mother will have to prove she has strong ties to her home country and has no plans on remaining in Canada long term. She will also have to pass a medical and you will have to show proof that you have purchased insurance to cover any emergency health expenses while she is visiting Canada.

And just to be clear - there is no guarantee either the regular visitor visa or the super visa will be approved. So there is certainly a chance your mother will not be able to accompany you to Canada.
