Dependant child: outland sponsorship queries- pl help

Hi
My husband, son and me got our PR cards in Jun 2010. We returned to India in July 2010 due to unavoidable circumstances. My daughter was born in India in 2011 and now has a 6 month visitor's visa to Canada. We'll be in Canada later this month.

My Query:
a) Can we apply for my daughter's PR outland, even tho at the time of application she'll be with us in Canada? We are very keen to travel together.
b) Can we try and get her visitor's visa extended so that we can stay together a bit longer in Canada? Is this extension to be sought by requesting the immigration officer at the airport, or later in Canada?
c) Assume we'd need the Upfront medical report from India before applying?
Any other advice for this to progress smoothly and quickly- most welcome!

Yes you can apply both inland and outland route

If you explain the situation at the border you can ask them if they would extend it up until a year, but you can also apply for an extension in canada through the website.

I don't know the answer to this, hopefully someone will come along and answer it for you.

I don't think previous poster's answers are correct.... Based on what I've seen in the forum (not personal experience):
a) Yes, you have to apply outland. There is no inland process for dependent children only -- though there is some H&C process you can go through if your child has a TRP instead of a TRV.
b) Yes, you can extend a visitor's visa. Apply for one online about 30 days before expiry, preferably with some evidence that the PR application is in process. Note, you could be refused, and at that point, the non-sponsoring parent could leave with the child until the process is complete. In that case though, hopefully the wait won't be much longer. I think though that an extension is likely to be granted with a PR application in process. (Very common for folks from visa-exempt countries to extend their visitors record while PR apps are in process.)
c) No, you can get medicals done in Canada.

As a PR, not a citizen, you need to be resident in Canada before sponsoring. So, you can't apply until after you're back in the country. (And presumably you should provide evidence that you are in fact currently residing in Canada.) BTW, are you currently meeting the obligations for PR? That is, are there enough days left before expiry of your card for you to meet the 730 days in Canada requirement? Otherwise, re-entry as well as PR application for your child may be problematic.

a) In terms of eligibility to sponsor my dependent daughter, what are the steps I must take to establish that I am a resident at the time of applying? I intend to take up a house on rent in Canada, enroll my son to a school. Is it correct to wait till all these are completed or can I apply to sponsor before? Should I be doing anything else?

b) I'll have time to be compliant with PR residency obligation. Is there anything else that CIC looks for when assessing eligibility to sponsor?

c) Is it preferable to get the upfront medical done in India or in Canada for an outland application? It might take us 1.5 months to apply for her PR after we reach Canada, due to house-hunting etc.

a) there is no "standard" answer. But explain when you came back to Canada, and provide proofs that you are here to stay : so even if your son is not in school yet, then provide the proof that you have started to enroll him. Having a lease would be a good way to show that you are established, and have a place to stay etc.

b)CIC will look also for evidence that you won't go on welfare. There is no minimum income requirement, but you need to be able to provide for your family ( either you, or your husband, whichever is sponsoring), so make sure that you include information about that as well.
c)do the medicals in Canada, as close to the sending date as possible. Medicals are only valid for 1 year, so wait until everything else is ready to do the medicals, then do them and send your application with them.

about entering: at the border, the maximum time you can get is 6 months ( most of the time). So - ask for 6 months, and explain that you will apply for PR. 1 month before her visa expires, file for an extension online, and ask for 1 year, add the proof that you have already applied for PR (first stage approval for example, or fee receipt). It doesn't matter that her visa expires if you have filed for extension before the expiry date - she will be covered under implied status until she receives the extension.

Thank you! Appreciate very much the additional information about entering.

Do we need to have her passport with us when we apply for her visa extension? From the forums, it seems that the Delhi office asks for the passport pretty early in the PR application process, sometimes just a month or so after sponsorship approval. How do we ask for extension in this case?

A couple of questions on the application-
a) since we are applying outland, am confused if the current mailing address and the residential address should be a Delhi address or of our rented house in Canada? This is required on IMM0008ENU (Generic application form for Canada).
b) my husband can get a letter stating the terms of contract for his employment. What other financial info might be good to submit? Deed showing rental income from our property in India? Anything else? He won't have filed taxes in Canada by then so I assume "Option C Printout" is not essential?

All of us are in Ottawa now. Thanks a lot for your help earlier in getting us here!
Applying for my daughter's PR now who is with us on a TRV. The place where we are stuck is what to put down as her residential and mailing address on IMM0008. If we put both these as our Canada address, isn't it an issue that we are applying outland? Also while sending the passport back later on, would NDVO require an India address?

No issue. Put your Canadian address down for both. Inland/Outland is more about where the application is processed, less about where the applicant happens to live.

Do a search or ask this in a separate thread. I think I've previously seen that India doesn't allow passports to be mailed and people have to give their passports to friends or relatives traveling to/from India to get this part done.
