Hi,
Please help me for understanding my daughter case under family sponsorship.

My present conditions is as follow:

1.Me my wife and son got Canada PR status on Aug 2012 and in Oct 2012 we returned back to India due to some unavoidable situation.

2. After coming back to India we blessed with baby girl in Dec 2012.

3. Now we have planned to go back to Canada permanentaly, so applied my daughter Sponsorship and PR in Dec 2014.

4. My sponsorship has been approved and PR application is in Delhi Office.

5. As per CIC we have to spend 730 days in Canada to maintain PR status, hence we all have to go back to Canada till max by July 2015 for completing 730 days.

6. Like I applied my daughter case in Dec 2014, accordingly i will get her PR till Dec 2015 or max by Feb 2016.

7. Recentaly i applied multiple entry visa for my daughter and it is also approved.

Now my question is as:


1. My daughter will go to Canada with us on TRV, so when we will receive the letter from CIC to deposit daughter Passports in India for PR stamp, what process i should follow being living in Canada(i have given communication adress as India to CIC).

2. After reaching at Canada can i change my mailing address from India to Canada? and can CIC allows me to deposit daughter passport in Canada for PR stamping.


Please help me in this.

Since you are a PR - you must be living in Canada in order to sponsor your child. Meeting the residency obligation isn't enough - you must be physically living in Canada. If CIC figures out you aren't living in Canada, you should expect the application to be refused.

You should change your plans and relocate back to Canada as soon as possible if you want to avoid having the application refused.

Thanks for your advise.

I want to share with you, 15 days back when i applied my daughter TRV, i clearly mentioned with supporting letter that i am living in India since Oct 2012 and i will go to canad with my all family if you grant me Visitor visa for my daughter as till yet we have not received PR for our daughter.

I also got sponsership approval from CIC, Canada and CIC forwarded my daughter case to New Delhi Office.

I think if they want to reject the my daughter sponsorship then they would not forwarded case to India and curent status is "Application Received".


Please tell me at what stage they may/might cancel the application:

1.Before approve Sponsorship at Canada? (In Feb 2015 i already for sponsorship approval)

2. Or at Home country (New Delhi)?

As i have only 3 months left to full fill 730 conditions to maintain PR status, so should i go back to Canada with my family or not?
After reaching at Cand with family if they rejecte my daughter file they i will be in problamatic situation.

Please suggest in above conditions
Your answer will be higly appriciated.

You need to relocate to Canada. Since you have a TRV and a PR application, getting into Canada shouldn't be a problem with your daughter. You most likely won't get any fast processing, it probably isn't worth it to try as right now you are "flying under their radar", if you ask for fast processing they might turn around and say "not living in Canada, ineligible to sponsor and deny the application"

If your daughter is denied entry, you can always apply for a Temporary Resident Permit on the basis of family reunification, but I don't imagine they will deny you entry (just a hunch). How long is the TRV valid for?

They can refuse to issue a PR visa at any time. Just because you got sponsorship approval does not mean that the visa officer will issue the visa for sure.
PRs are supposed to be in Canada during the entire time the application is being processed. I would go back to Canada as soon as possible. Your daughter has a TRV, so should probably be let in. If not, you can apply for a TRP as noted above.

Writing a letter to CIC asking for faster processing times won't help. I would not bother.

My daughter TRV is valid from May 2015 to Sept 2018.

We are planning to to to Canada in June 1st week.

Can i send a request letter to CIC for change mailing address in Canada instead of India for submitting daughter passport for stamping purpose?

You should be able to update it on ECAS once you have a address in Canada.

However, it may be easier to have family forward the letter you get (or just copy and email) and then send a letter requesting it be returned to Canada at x address with the passport (lower chance of mistake that way).
