Back in 2011, my husband was visiting Canada (Vancouver, BC) and he applied for student visa within Canada. His application was refused (although accepted at the university) and shortly afterwards he returned home.
He wanted to study graphic design, so eventually he ended up completing his studies at home.
Now, a couple of years later, we would like to apply under Express Entry as a family (3 applicants).
Our biggest concern is how this past “issue” will affect our current application.
Because, of course at the question: “have you ever been refused admission to, or order to leave Canada or any other country” we will respond with YES and we will explain the whole situation without withholding anything.
Still there is a huge question mark looming over us, whether this so-called “incident” will negatively affect us.
Was his student application visa back in 2011 considerd as a criminal act ?
Any advice, past expriences maybe ?
 
No issues unless one is deported or got rejection due to some criminal case.

If this is not the case in your profile, you are good to go . Rejection will not have any negative effect on the application . Just mention your rejection in the application and put Explanation Letter to justify your rejection

Having said that, whether or not there is a negative impact on your PR application depends on the reason why the student visa application was rejected.

If your husband simply didn't meet the requirements, this is not a problem at all.

If your husband made false statements, misrepresented himself or, even worse, forged documents etc., then his PR application will probably not be viewed favorably and will be under intense scrutiny at the very least.

The thing is he never submit false statements or misrepresented anything. Everything went well, he even got a scholarship...the only "bad" thing was that he applied for a student visa (while on tourist visa) from within Canada. He was still in Canada, Vancouver to be exact, when he applied for the student visa.
This is our biggest concern and worries us greatly :(
