Hi Guys,
I am on the one year IEC visa and am applying for my second IEC visa so that i can stay here for another year. Because i'm in Canada it took me longer to apply than I thought as I had to send photos home so that my mum could send off the application, and they did not sign for it until the 29th of Feb. They have posted on their website that they have a high volume of applications and so processing times are high. I still havent received an email to tell me they have started processing it, and I know that they say it takes 8 weeks for the application to be processed, although for some it only took 5 weeks and for others it took 11 weeks.
My current visa runs out on the 12th of April, and I didnt mind having a couple of weeks off work if I needed to but now it looks like its going to be a lot more weeks than that, possibly longer if there are other problems with the application. I was wondering if there is a way to get implied status. I have seen on the forum that people recommend applying for a visa which you know you wont get, because in the meantime I would get implied status. I don't have 30 days left before the end of my visa though so i'm not sure if i am able to do this.
What I would like to know is:
1. Is it possible for me to still apply for a visa to get implied status even though I don't have the 30 days left on my visa?
2. If that visa gets refused will that affect me in the future if I am to apply for another visa (If I wanted to stay in my job then its possible I could get an LMO with them and stay for longer)
3. Is there any other ways to get legal work status until my IEC visa gets processed - I feel its a bit unfair at the minute because processing times are so long! I know I should have applied earlier but I wanted to make sure that I wanted to stay here before I did so.
4. If I just continued to work how likely would I be to get caught? My SIN number also expires on the 12th or 13th of April so would they be able to pay me?
5. Could I keep working but not get paid until my visa comes through? Would that be illegal? I have enough money to get by for a couple of months but the problem would be by the time the visa came through I would have to wait for a while before getting paid, and it seems a shame to just sit around doing nothing when I could be working and getting an income!
I dont know if its relevant but my job is as a professional fundraiser. I work for a for profit company that fundraises on behalf of not for profit organisations. I wondered if I would need an LMO for this because its technically charity work?
Any help anyone can give me would be very much appreciated!
