Deferral Letter/study Permit- Please Help

Hi,

My brother landed 15 days ago, his college supposed to start from 05'May 2018. but he got deferred letter from college as unavailability of seats and offered him to go September session. is it illegal for him to stay? someone said he will not get his work permit after his studies, is that true? what should we do?

he is legal there but he must take small program in same DLI or just update DLI, in September update his DLI again, and if he is not in any school (active study) then don't work its not allowed. only active students are allowed to work.

best path is ask him have a certificate in same field, it will help him build career and will allow him to work too from September life back to normal

My understanding is that
If he got his visa late from canadian immigration,then this is not his problem. The college should entertain him whatsoever.
College should notify immigration about his status,not him
Better make the college responsible and make them to take care,after all you have paid huge fees

The college cannot be "made responsible" for anything to do with his status in Canada.

And when he asked them in college that he should we do till september - they said go to "vacations". they are not taking any responsibilities.

and the best part is its not just him, approximately 200 students got the same letter from the same college due to unavailability of the seats,

we called up immigration, they said you can apply for visitor visa, but study permit will get void then. so , he is in trouble.

If I would have been there I would simply written a letter to immigration saying that I have applied my student visa in the proper time frame as per mentioned in visa office instructions,
Now
Why I am being side lined by the college saying me they have no seats available,
And also had asked them to grant me working rights.Because there is no where written on cic website that If you have been granted visa for particular intake(does not matter if it gets late), the college won’t allow you to sit. Its their duty to notify immigration that we have seats full now.
Its illegal !!!
Imagine a student spending his GiC, and not working.He could have taken education loan.

Sam my advice is donot take any alternatives.

Pressure college to do something
Read student visa guidlines on cic website and ask answers from them

we called up immigration, they said you can apply for visitor visa, but study permit will get void then. so , he is in trouble.

The most important thing is to update his new resumption DLI date to his CIC account. If he has sufficient funds to take care of himself and other little expenses before the new resumption date of his program, I don't think he will have any trouble given that he shouldn't work or try to do any illegal work for funds, this might ruin his PGWP future application

There are many students who go to Canada 3 months before the start of their program and the only proof shown to the CBSA is proof of sufficient funds to be able to take care of expenses before the school start fully

He shouldn't enrol in any course before his program starts as it might later been seen as an obstruction and might make him ineligible for PGWP

It was the best option for them to do, what if they are withdrawn the admission and his SP application was refused due to the university, won't it have been worst?

The individual is always responsible.

You certainly could have written such a letter but IRCC wouldn't have given a damn and most certainly wouldn't have "given you work rights" in contravention of immigration law.

But Its immigrations officers responsibilty to check the intake date and issuing visa date.

Or better raise the issue with ministry, because every trv holder-has their rights, if they are aware off.
