There was no place in the letter that stated if you were on full time or part time employment.

2.It is further added that he was getting a salary of Rs. 35,000.00 per month when he left the job.
The letter did not state how much you were earning when you were working with the company. It only stated how much you were getting when you left the job. IO might wonder why the company will be paying you when you were no more with them or is the wordings of the post or letter wrong?

This is what i can figure out from the letter you posted.

His company has actually proved that he has more than the required experience as oppose to your own comment.

Secondly,methink that the issue of stating full full time or part time on his reference letter is not required at the
time of his application. This is because the Visa office in charge of his country knows what is obtainable there.

We hope to find away around this.

Well aftabz ,very sorry to hear about your case.

Your job responsibilities letter appears ok to me ,but honestly as I have never gone through official JD of your NOC so dont have much idea that how much it matches with it.Honestly when I send my JD letter ,I searched my particular NOC official JD ,modified some words(without sacrificing the real job responsibilities) added some more duties regarding my job and got it signed by my HR.

But apart from the fact mentioned above I personally feel that in the current circumstances,when CIC JUST want to slash the backlog by hook or by crook,this is happening with many many applicants.Infact only in the month of April (especially after March 15th) I have read experiences of many applicants whose cases were rejected simply because the VO was not satisfied with their JD.So it appears that VOs are purposely eliminating the backlog by heavy rejections and I am sorry to say that you appear to be one of those victims .

In my view there is no harm in going for writing to your IO though there are less chances in current scenario.My honest advice to you will be that wait for next set of occupations/instructions and if your NOC is included in the list, just reapply .

I think you are correct. The job responsibilities on my JD matches about 80 to 85% with what is on NOC. But the problem is that this occupation has been removed from the current list of occupations. So I guess they just threw it out on some flimsy grounds.

I am taking it to the next level. Currently my agent has written a letter and if I am still refused then I will appeal in a Canadian court. I will take it to the end.

I can't afford to apply again. Not only does it costs more money but already so much time has elapsed. Plus there is again no guarantee that applying again would lead to positive results.

This is just so unfair on part of Canadian authorities. I have excellent educational credentials and my English language skills are much better then plenty of candidates that I have come across. Just very unfortunate.

Hi brother!

Well I would certainly recommend you to take your case to the next level.But before going into the court try to research as much as possible about any similar cases .If you want to file your case in court try to find a good/reputed/honest CANADIAN lawyer which could prove very helpful for proving your claim in court.

I would like to wish you all the best for your future endeavours but in the mean time I would also like to take this opportunity to tell you that I have met and seen many people who were rejected for the first time but they didnt loose hope and tried again and now they are in Canada.My own case was just like a roller coaster ride,it took many ups and down but alhamdolilah at the end everything went fine. So just give your 100% ,trust in Allah(swt) and I am sure you will be through.

Now our Lawyer will again write a letter to IO with the evidence that we are 2010 applicant not 2008's. She wrote request letter to reconsider, a week after getting Refusal.

Maybe some will get +ve hope from our case history..

Am not been rude,going to court is not the solution but to re-apply if you so desire. CIC has the right of decision and processing your case to get PR is not a right I hope you know.
