Death of Principal Applicant after Issuance of COPR and Immigrant Visa

Hi,

I would like to commence a discussion on the subject matter. My parents successfully completed their Family Sponsorship process and were grant Confirmation of Permanent Residence (COPR) and Immigrant visa. Both my parents were excited to reunited with my family here in Canada and were planning to immigrate on April 4, 2017. However, on March 4, 2017, exactly one month before their planned travel date, my father suddenly passed away. As per the policy of IRCC we informed them about the sudden change in my family circumstance. IRCC said that because my father was a principal applicant my mother's visa is no more valid and a new visa and COPR document will be issued.

While this sounds very strange to me, that once visa and landing papers were issue why my mother's sponsorship application (now as a principal applicant) need to be reassess? I thought this would be a simple change in family circumstances process in IRCC system. I would to like to learn more about this. Did any body had this situation before? How long this process will take?

I will appreciate your comments and discussion.

If the COPR has already been issued, this may make it easier for your mother. The part below (from the link above) seems a little unclear to me, though:

When the Principal Applicant (PA) on a parent or grandparent application for permanent residence in the Family Class passes away prior to permanent residence being granted and where the sponsor makes a request, the officer may replace the PA with the individual identified on the application as the accompanying spouse or common-law partner in cases where they are also eligible to be sponsored as a member of the Family Class by the sponsor (i.e. not a step-parent or step-grandparent).

Being granted is what sticks out to me, since even with a COPR a person isn't truly granted PR until they land and have the COPR officially activated.

My dad passed away who was the principal applicant During the last stage of the parent and grand parent sponsorship PR.
The COPR is already issued to both dad and mom.
I already updated the death certificate with IRCC.
And requested my mom to be changed to PA now as she is the dependent.

would you be able to tell me what will happen now and how long does it takes for the change to happen.

I don't know if they explicitly requested this or terminology, but presume as basic as advising that PA has passed away and confirming they would still like the dependent-spouse to immigrate, can that person be named principal applicant. Or requesting which next steps can be taken.

Would add when asking to change PA include the death certificate.

It’s important to update the IRCC thru web form immediately about the unfortunate demise of PA. and
Request them to change the dependant to the PA in the same letter.
I updated IRCC in June 2024
After repeated follow ups they finally changed my mom to PA in November 2024 and sent a passport request.
I am waiting for her virtual landing.
Please be patient…..
And you can also reach out to your local MP office.
All the best.

There is no need to reach out to MP. Contact IRCC, request change of PA and forward death certificate. Should solve the issue.
