If the appeal is positive and you get your TD, you can return to Canada and apply for a PR card based on the appeal and TD. However, you should still not leave Canada for 2 years because even if you win your appeal, you are not exempt from meeting the residency requirements. If you were to leave Canada again before you do and something happens to your PR card and you must apply for a TD again, immigration will most likely refuse based on that you had your chance and didn't use it.Ayham Ahouban said:I understand these points, but may I ask you a further question, what if the appeal decision would be positive, am I going to apply directly for a new PR card or I need to stay till meeting the residency obligation 730 days ?
