I have questions regarding custody of the children and obtaining medical exams. My husband has full custody of his 13 year old son and currently lives with my in-laws. Does he need to get a letter from the biological mother to allow him to leave the country and live in Canada? Also, with his daughter his ex-wife has basically gone off the face of the earth and will not let anyone on my husband's side see his daughter, she is only 4 what if the mother declines to do medical exam when and if we find her?

Hope someone can help me out :)

For the son, I don't think you don't need any letter from the mother about allowing him to go to Canada. The only important thing is he does the medicals.

For the daughter, there have been several cases i've read of ex-spouses and kids disappearing or breaking off all contact, meaning the children are unable to do medicals or be included in the application. With full explanations the application can still go through, however the key point to know is that the daughter will NEVER be allowed to get sponsored in the future if she is not included in his application now.

If your husband is European, he may still be required to give notice of some kind to the mother.
I came across this website when I was researching this issue with my partner:

http://ec.europa.eu/civiljustice/parental_resp/parental_resp_int_en.htm

On the right you click the flag for the country you are interested in. At the top right you can choose the language from the drop down menu.

As Rob_TO stated, "the daughter will NEVER be allowed to get sponsored in the future if she is not included in his application now." So keep that in mind.

If the the couple have a child, and that child is born in Canada, will s/he be able to sponsor his/her half sister?
