Currently on Job but no LMIA for Express Entry

Hi Guys,

I'm currently working as NOC A and i can request a job letter to our company if it is needed but I'm quite confused on the LMIA.

Currently my score for arranged employment is:
CRS - Arranged Employment 0

I am currently employed in a Canadian Company with NOC A Job description. When I was reading: https://www.canada.ca/en/immigration-refugees-citizenship/services/immigrate-canada/express-entry/documents/offer-employment/lmia-exempt.html

I notice to be exempted it should be:
    1. have been working full-time for the employer on your work permit for at least one year (or an equal amount of part-time work)
    2. have a valid job offer, and
    3. have a valid work permit that is exempt from an LMIA under
      • an international agreement
      • a federal-provincial agreement or
      • the “Canadian interests” category
For the first 2, I qualify but the third one is a bit vague.

The company is a Canadian Company, small size tech consulting company so I am not sure if that qualifies as "reciprocal employment"

It looks like you hold a PGWP. If that's correct, then your employer needs to obtain an approved LMIA in order for you to qualify for the 50 job offer points.

Is it possible to get an LMIA even though I am already employed and will it affect their business in anyway?
Hey Justin, I am in the same boat as you. After talking to my employer recently they have agreed to provide a new job offer and apply for a LMIA, but we haven't begin the process. See my thread here.

They will need to advertise the position for four weeks and then apply for the LMIA. There is a processing fee of $1,000 and I believe a "privilege fee" of $100. I found this article that may be helpful, which includes this passage:

Employers must also advertise all job vacancies in the Canadian job market for at least four weeks before applying for an LMIA and are required to prove that they have used at least two other recruitment methods in addition to having posted an advertisement on the Canadian Job Bank website. Employers must focus advertising efforts on groups of Canadians who are under-represented, such as Aboriginals or persons with disabilities.​

Oh wow, that's good your company agreed to get the LMIA, I am afraid to talk to them about it.
On a good day will try to convince my boss about it, will gather some procedures and documents to lessen the load, if it matters I can pay the fee if they don't want to.
