:-\ This is the last thing I wanted....My current employer is not giving me the experience certificate....and asks me to resign if I want the experience certificate....!!!! The explanation he gives me that is that he cannot encourage any employee of his to plan to leave the company in the future....!!! and even if I resign....the experience certificate with roles and responsibilities cannot be given as per the rules he says....hmmm....I work in a goddamn govt company in India.....never knew so cruel the system is here...!!! Moreover as I work in a govt firm....I need to get an NOC(No objection certificate) to apply for this PR visa it seems....informed by my consultancy...which my firm will Neva give.....Such a helpless situation..... ??? Anyone can help me get out of this situation??

How about asking a colleague to write about your roles in the company?
You could then add an explanatory letter that your company is unkeen to write a reference whilst you still work for them, and then add supplementary evidence such as job contract and/or payslips.

I doubt CIC will accept a work experience letter from someone of non-managerial level. It must be written by the person's manager or supervisor.

In this case it's really a question of knowing employment laws within a country and standing up for one's rights. Regrettably some countries I think there is no real legal requirement to give reference. In the UK (where I am from) although it is illegal to give a bad or unfair reference. I believe it is completely legal to refuse to give a reference.

If you can speak to someone higher up and try to get someone to get your manager to see reason then I wish you the best, but the bottom line is that it's unlikely that they legally must give you the reference, so it's at their discretion.

I was informed that I need to get all the employer letters from HR department only (who are the authorized personnel to give such letters with company's official seal)....The above replies were given by the HR manager only....Should I approach my department's manager directly to give a reference letter??!! I m not sure if he is authorized to give any such letter....and whether he ll accept my request or not...even if he gives will it be accepted by CIC??

But, even then ,I ll still be short of the NOC(No objection Certificate) to be issued by the current employer(in case of govt. companies) to apply for VISA....I dont think anyone can give this except HR dept...!! Has anyone given such NOC....??!!!!

you are facing a tough situation ........here in Pakistan the situation is the same even if you have to apply for first Passport you have to get N.O.C. and that is really tough job at least in Pakistan ........

well.. cant you say that you need that letter to apply for a course in a University which you will do part time :p and that you need to show to the University what job you do and for how long you have been employed?

I know one need to be honest but your manager is just making things difficult for you.

One of my colleagues has also faced the similar problem while sending his application for the FSW program. If your current employer is unable to give you an experience letter/NOC, you can do the following things:

1. Attach your Appointment letter, copy of Job Description and recent pay stubs.
2. Write an explanation letter mentioning that it is not your company policy to give experience certificate while you are working. Give references in the explanation letter, with whom CIC may contact to verify your employment record. The references should include the following person: Your current supervisor/department manager and HR rep.

I hope CIC will understand your case.
