i talked to an immigration lawyer and he told me that based on my felony i could only apply for criminal rehabilitation until december 2023. until that date comes, what happens next after someone applies for criminal rehabilitation assuming that they get approved somehow? what are the next steps after applying if ones application gets approved? what the next thing that i need to do to move forward if my goal is to obtain legal permanent residency assuming that i fall under a category in which to immigrate? can anyone please tell me. rsvp. thank you.

You cannot enter Canada until your rehabilitation application has been approved and you can't apply for anything until that time.

So there's really nothing you can do between now and 2023. Once it's 2023, you can apply for rehabilitation. It could take anywhere from several months to several years for your rehabilitation application to be processed. If your rehabilitation application is approved (there is no guarantee it will be), you can then apply for permanent residency if you qualify.

when you say that there is no guarantee, what do you mean???? if someones criminal rehabilitation application is approved and they qualify for permanent residency, then what could possibly hinder them to the point where there would be no guarantees then????? rsvp.

What I mean is that criminal rehabilitation is not always approved. Sometimes CIC will refused the application because they feel a felony is serious enough that they do not want to allow someone into Canada.

If your criminal rehabilitation application is not approved, then you can't apply for permanent residency.

but what type of felony will be so serious enough that cic will not forgive it? what if it was a drug offense but like 14 years went by after that person made that mistake and they didnt go to prison but got probation instead? rsvp.

There's no list. It's really up to CIC whether they accept your application or not. None of us can predict what will happen. You'll just have to submit the application in 2023 and see what happens.

I can't answer your questions. The only thing I can tell you is that criminal rehabilitation applications are not always approved.

well, do you think that some criminal rehabilitation applications do get approved while others not? if so, what are the deciding factors if a border officer determines that someone is truly rehabilitated? rsvp.

It's basically at the discretion of Immigration Officer, assuming criminal rehabilitation has been approved. All else equal, it really depends on how much they believe you would not commit the same crime in Canada and your set of skills would be beneficial for Canadian Economy. Also, likability factor is pretty big considering what I've read around the forum.
