criminal rehabilitation - pre-emptive application

Hi,

I have a dui offence the sentence of which ended on sep 19th, 2007. I can apply for criminal rehab on 19th sep 2012. Can I pre-emptively apply for criminal rehabilitation now? I am making a PR app with my canadian partner as a sponsor and would like to speed the process up as much as possible.

1. No you can't apply until you are eligible, but you can apply for a Temporary Resident Permit if your reason for visiting Canada is considered necessary. See: http://www.cic.gc.ca/english/pdf/kits/guides/5312E.PDF page 9. I note from your previous post that you stated that you are in a Common/law relationship in the past, but have been separated since she returned to Canada in Aug/08. I think that you are going to have difficulty proving that you are still in a C/law relationship after 18 months separation.

i travelled there with her in aug 08 with the objective of getting a trp >6months and also applying for a work permit. this i attempted in february (after a short trip back to england in which she accompanied me to attend the funeral of my grandparent). we separated only because i was not granted this so could not find employment in canada, therefore support myself. she had started university in sep 08, so could not return to england with me. she finishes uni in dec 2010 and is due to start medicine in sep 2011. it may be the case that she has to study in england for us to be together. HUGE tuition fees for foreign students.

also, does it matter that i went to canada this holiday season without applying for a trp? i was never asked at the border but have never lied about my dui.
