Hi,

Sorry if this is in the wrong thread group. I couldn't find one that would fit.

I'm a NZ citizen living in Australia and want to fly to Canada for the foreseeable future (as long as visa allows me) to be with my Canadian partner, who is a citizen.

Can I do this? I won't be returning to Australia, can I do it on a tourist visa, what evidence would I need to prove common law? Will I be allowed to leave Australia? (I'd no longer be classed a resident I think)

I've applied for IEC and PR but I need to leave now.

The information I'm reading seems conflicting. Has anyone done this?

I'm sure you can leave Australia any time, the question is whether you are common-law since you are living there and your partner is living in Canada. You generally need to be living together for at least a year with shared expenses, etc. And of course, to enter as a visitor they need to be satisfied you won't work illegally and will depart for NZ if required.

Right now travel restrictions are in place for entry into Canada that only allow for essential travel. You would need to demonstrate that you are in a common law relationship with your partner (i.e. have lived together continuously for at least one full year) to be permitted to travel to Canada at this time. Do you have proof of common law status? Best proof would be something like a joint lease that covers at least one full year.

IEC draws & invitations are on hold at this time.

In terms of leaving Australia, that's a question for an Australian forum.

Thanks for the response. We've lived together for 3.5 years (Canada & Australia) , but with not a lot of evidence. We travel a lot so are never in one place for long. We have thousands of photos, videos, one combined car insurance, letters from landlords (never officially rented). Would that be enough?

I have a large amount of savings and I don't need to work.

Thanks for the response. We've lived together for 3.5 years (Canada & Australia) , but with not a lot of evidence. We travel a lot so are never in one place for long. We have thousands of photos, videos, one combined car insurance, letters from landlords (never officially rented). Would that be enough?

I have a large amount of savings and I don't need to work.
Photos and videos aren't regarded as proof of cohabibation.

The combined car insurance and letters from landlord should be helpful.

None of us here can say if that will be enough. You'll have to try and see what happens.

Note that you'll need to quarantine for 14 days once you arrive in Canada. If you plan to live with your parnter immediately, this means your partner will need to quarantine along with you for 14 days. If your partner is unable to quarantine for 14 days (i.e. not leave the house / apartment for 14 days straight), you will need to quarantine elsewhere and then join your partner once the two weeks have been completed.

Do you no if there's anywhere I can ask to find out if it's enough information? Canada is a very long and expensive flight away to be turned around in customs and told I can't enter. Not mention all the other factors that need to happen just to get there.

Generally to prove common law status you want proof of cohabitation, like a lease, utilities, bank accounts listed at the same address, etc. Anything you've got to prove 1 year of continuous cohabitation.

There is no way to guarantee you will be allowed to board a flight and enter Canada due to the travel ban in place. If you want to avoid any risk of being denied boarding / entry, the only option is to defer your entry into Canada until the travel restrictions have been lifted.
