I am currently residing outside of my home country (5 years) . Can I put my country of application as my home country (processing time is significantly low as compared to where i reside currently)?

Will it be considered as giving false information?

After going through the forum, I understand that individuals have to be physically present in the country in order to put that particular country in country of application. Is it true? Is it applicable for home country?

No you may not.

You have to apply from the country you are in. If you haven't been to your home country for five years, you are misrepresenting. They will find out relatively quickly on background checks.

Well i have visited my home country multiple times in 5 years.

If it is asking country of residence, and you are residing abroad. Then where is the question of putting home country as a country of residence. If you want to apply from home country then you should move back to your home country from abroad permanently and then only apply from home country.

You should not put the country of residence when applying as your home country if you are not currently living there. First of all, you may need to provide medicals and biometrics in the country where you are applying. Secondly, it will take the VO 10 seconds to know where you really live when applying and if he finds out you lied, you will be charged with misrepresentation and most likely banned. Don't end your application before it begins and do the right thing. Good luck!

I believe I've given a wrong impression here. In IMM 1294e Question no. 7 asks 'current country or territory of residence' and Question no. 9 asks 'Country or territory where applying: Same as country or territory of residence'. I am definitely going to answer question 7 truthfully but my question is even though I am not physically present in the country of which I am a citizen, can I put my home country in Question 9?

I am well aware that misrepresentation is not tolerated and would lead to a ban, therefore, I created this thread in order to avoid giving wrong information.

So if you are applying in your country of residence why would you consider answering that question with a different answer?

If you want to put your home country in that box, go home and submit from there. The question asks you to honestly declare where you are when you apply. It's a question for students who are not in their country of residence when applying.

The question determines where interviews are held, etc.

Well, that does create a few problems for me one of them is not able to meet the deadline of the institute. Instead of going home is it possible my brother could submit my application online?I could authorize him by 'use of representative form'. Also, what would the country or territory of residence and country or territory where applying then?

The question is where you as the applicant are, because they may wish to interview you. Not from where someone can be a representative. If you made me (in Vancouver) your representative, I would still have to put your country of residence as where you are residing.

Friends I have a similar problem... gf lives in Australia since 5 years ago, went back home (country of citizenship) to El Salvador to visit family and doing some chores pending so applied for TRV to come see me before going back to Australia but application was filed as country of residence El Salvador with the reasoning that she is currently there even if temporarily. Application was refused due to financial standing, job prospects and job situation. We thought that we made a mistake since obviously all her money bank accounts, studies and job are in Australia so we filed application again as -country of residence: Australia- and -country where applying: El Salvador- and explained in a LOE that it was a mistake on her part to have said otherwise in previous application and that she actually lives in Australia.

my worry is, are we in some kind of trouble for doing this? saying one thing first and then the other? It's really not a lie since all of her things and records are in Australia but she's currently in El Salvador temporarily. please share opinions

You may get questions about the change in country of residence and may be asked to provide documents proving the change. It would have been advisable to include a letter of explanation in the second application.

We did, we attached a letter of explanation LOE saying that it was a mistake on her part to have submitted previous application with country of residence El Salvador because she's there only temporarily and that she actually lives in Australia. Proof of the reasons of being in El Salvador plus more proof of her Australian banking accounts and pension plan, a job letter from her boss giving long leave from her duties and diplomas from her studies and placements where provided. We stil haven't got an answer. processing time for El Salvador applications is 13 days and Australian applications is 18 days... we're on day 12 I believe

I'm also wondering if they will process in Australia because of declaring current residence in Australia and then transfer to Mexico for PPR because Mexico is closest visa office to where applying from (in positive outcome) or they do all processing in Mexico since the start?
