employment insurance ofr 9 months india 7 month back 2 months and worked then eft again and didnt work

Hi All!

I am a US citizen applying for family class PR with my Canadian citizen spouse sponsoring me. We are both travelers who don't care much for working, so have spotty employment histories. We are wondering how this might affect our PR application.

I'm under the impression that my employment history won't be much of a factor as an immigrant coming to Canada, but we are a bit concerned about my sponsor spouse. From what I've read, financial ability is not a factor. He has had 3 months temp work and a full time job now for 3 months in preparation for our applications going in. However he has a cleared bankrupcy in his past, has rarely kept any past jobs for more than 4 months before moving onto something else. He was on employment insurance for 9 months and then went traveling out of the country for 7 months, then he came back worked for two months then didn't work again until 6 months ago.

Could this become an issue in our application process?

It should not be an issue with CIC; however, some forum folks may advise to at least address it in your application, as well as your future life plans :D. When it comes to spousal sponsorship the only "for sure" refusal is if the sponsor is receiving social assistance/welfare/workfare benefits. Disability benefits and employment insurance (EI) are both fine. Your sponsor will need to submit what is called an "option C" printout from Canada Revenue Agency (CRA) so CIC will see his low income. Often couples in your situation (or others who may be students or may have other reasons for low or no income) explain in their applications what their plan is to support themselves. For example, live with parents/family/friends rent free and submit documentation to support the plan.

I am sure you will hear from other members shortly. I cannot recall if there is rule re: bankruptcy or not - as the rules have changed a lot over the past few years so you may want to Google that issue or even call CIC. It could even be in the application guides or on CIC's website. It may not apply if the person has been discharged or if a certain amount of time has lapsed.

Does anyone else have any experience with this CRA option C form? What exactly is it, and what does it prove. Should I send this with my intial application or wait until it's requested?

it is a detailed notice of assessment from CRA, and is REQUIRED for the sponsor's application. If you don't send it, the application will be considered incomplete. Option C forms are available for any year you have filed taxes, so if the sponsor has not filed taxes yet for 2013, they need to do it asap. It can take 4-6 weeks after filing for CRA to finalize tax returns and for the Option C to be available. You will have to call CRA and request it. It takes about 5-10 days to receive it in the mail, and the ORIGINAL copy is required.

The option c forms confirms the sponsor has not been on social assistance. i am not sure how a cleared bankruptcy affects sponsorship.
 
Cleared bankruptcy won't effect his sponsorship . He just can not go bankrupt while he is under sponsorship. He can not collect welfare. He can however collect E.I.
If you cant get an option C print this is what CIC SAYS TO DO ., If you do not provide this printout, provide an explanation on a separate sheet of paper . Just explain why .
