Correct NOC for foreign lawyer

Hi all,

I'm hoping to apply for FSW stream under EE. I'm currently in Canada on a Working Holiday Visa and currently work as a contract paralegal (I know - was a silly choice not to be employed as I could have gone through CEC).

In any case. My work history is that I worked for 3.5 years in Scotland. The first 2 as a trainee solicitor and the last 1.5 years as a fully qualified Solicitor before coming to Canada.

I was hoping to claim 3 years of skilled foreign work experience for CRS points however I have a nagging doubt that I can apply under 4112 (Lawyers and Quebec Notaries) as I am not accredited in Canada. I have of course carried out all the relevant job duties at home in the UK under this heading but I am worried the lack of Canadian accreditation rules this out.

Do I have any options? Is it possible for me to apply under NOC 4211 Paralegal and related occupations?

Anyone else had experience with this?

I find it crazy that a qualified foreign lawyer can't apply as a skilled worker but a foreign paralegal could. Surely there are skills transferability there? I do plan to do my NCA's in the near future. Is there any value in that?

Hi, you can just send an email to National Occupational Classification enquiring on which particular NOC is suited to your situation for immigration.

I am also looking for confirmation. I tried emailing the suggested email but got an auto response that it is not monitored. This service is no longer in use?

I think I am correct in NOC code 2264: Construction Inspectors, but could anyone shed any light?

Responsibilities/ Duties:

· Review the customer’s specifications, plans, drawings and ensure all requirements are being met. Site inspections to ensure construction is being installed as per engineered drawings and conforms to applicable federal codes and standards.

· Create and distribute non-conformance reports and organize and document remedial action.

· Create and maintain a comprehensive weld mapping documentation system.

· Collection and organization of welder qualification documentation of all welder operators. Review, accept and document qualifications of welders on site prior to welding.

· Maintain an active listing of all welds at site, track status and compile the information into the QC file management spreadsheet on a daily basis

· Coordinate with the third-party Non-Destructive-Testing Inspection Company for all non-destructive testing on site. Review and organize all NDT reports into the QC turnover package.

· Coordinate with the customer’s QC representative on all quality matters.

· Create the hydrostatic test packages for NDT compliance prior to testing, monitor test while in progress, inspect works whilst under test checking for leaks, provide reports accepting or rejecting post hydrotest.

· Monitor the control and issuance of welding electrodes.

· Advising the site foremen with regards to welding and testing. Visually inspect all welds completed on site for conformance to code. Advise and document repairs and/ or defects. Witness and document any remedial repair welding.

· Inspect all welds against detailed engineered spool sheets for conformance to general arrangement, material grade and dimensional conformance.

· Complete and coordinate the approval of the site’s QC technical submittals to the customer.

· Mark up isometric drawings with welder, NDT and pipe support installation.

· Coordinate with the site construction manager on all quality issues.

· Participate in the site weekly meetings with the customer’s representatives and present on behalf of the company with regard to project QA/QC updates and status.

· Inspect mechanical works: pump and motor installation and ensure sign off for each critical stage and quality standards are being met.

· Witness air blowing, flushing and cleaning of lines prior to commissioning. Create and deliver reports to client.

· Inspect final piping installation for deficiencies: compile reports and lists.

· Participate in final acceptance inspections for conformance to client specifications and record results on inspection checklists.

· Ensure all quality control documentation is compiled and completed for as-built hand over for all field installation and construction to the customer’s QC manager. Compile final turnover documentation for client containing all information pertaining to on site installation.

There's no need for Canadian accreditation to get CRS points for work done by a foreign lawyer.

All you have to check is whether your main duties fall under NOC 4112 (for lawyers) or under NOC 4211(for paralegals). A law graduate can work under any of these two categories.
