Hi Everyone,

I am working as an Independent IT Consultant for almost an year for a firm. I am on contract and I have incorporated (PSB) as well. I am working 40 hours per week as per my contract.

I checked following page

https://www.canada.ca/en/revenue-agency/services/tax/canada-pension-plan-cpp-employment-insurance-ei-rulings/cpp-ei-explained/canada-pension-plan-employment-insurance-explained-information-technology-consultants-employees-self-employed-workers.html

From many points if fall in an employee category and from a few others I don't.

I am not sure if I can be considered as an employee or not.

Any help will be appreciated!!

Thanks in advance.

To my knowledge, Independent contractor are considered self employed and are excluded from CEC, as they do their own taxes and do not get any benefit like a usual employee does.

I would wait for an expert to comment! :)

Agree, self-employed... (or, that's how IRCC will see it).

Hi jes_ON,

Thank you for your inputs.

I called CIC. I mentioned same thing that I do my own taxes. They said being incorporated is not the only factor they consider. There are other factors such as control on work, location etc as mentioned in the following link:

https://www.canada.ca/en/revenue-agency/services/tax/canada-pension-plan-cpp-employment-insurance-ei-rulings/cpp-ei-explained/canada-pension-plan-employment-insurance-explained-information-technology-consultants-employees-self-employed-workers.html

They said attach as many documents as you could. Immigration officer will make the final decision.

Could you please guide further?

Thanks in advance.
