I am stuck here with my points. My employer wont do LMIA... Already maxed IELTS... So the only thing left to do is continue studies..

However, I have a question, I have a 2 year diploma from a Canadian college...That programs also offers another year of studies... Which will upgrade my studies..

Now the question I have is, if I do that one year of study, would that be considered as one single diploma for 3 years of studies or will I have 2 different diplomas, one completed at 2 years and one at one year...
 
Tough to answer without knowing details but it appears to be a single discontinuous course of 3 years duration. Check it with WES/CES/ICAS before taking the decision to spend time and money on this endeavor.

Need more details on your profile to answer this further. You should probably retake IELTS and aim for CLB 9/10 (at least 8 in L and 7 in R/W/S).
 
None of these institutes seem to have any idea about my query ... May be you ( Asivad ) can direct me somewhere

All I have done is 2 years diploma from Canadian college... That program also has an upgrade.. which is one year of study...More points are awarded if we have a diploma/degree of 3 years or more...

Now my question is if I complete that one year.. will that be counted as one single diploma ( Discontinuous ) and I will get those points or will it will two different diploma's done at 2 years and one at 1 year....

I don't claim to know anything beyond what can be gleaned from the accrediting bodies. In your case, you don't even need an ECA because it is a Canadian diploma - maybe you should just check with your institution and ask them if you will be provided 2 distinct diplomas after completing that additional year (then you can choose 'Two or more...') or only 1 comprehensive diploma for a 3 year course (just choose 'Bachelor's degree or..').

It is not about me... I know someone who has illegally overstayed her visa.. It has been more than a year that her work permit has expired.. She just would not leave the country... She always lies about her status to her family back home, but I know she is staying illegally ...

She has created a profile and expecting ITA in the near future... Let's assume she does get an ITA, how would she go from there ? Would she need to go back to her home country to continue her application or staying here would do the trick ?

Big risk. For instance, it will be tough when it comes to things like background check and personal history for the last year or so. She will be asked for PCC for the last year and clearly she can't submit an application to RCMP for that or even her home country (because she never went there!).

I imagine she is in for a tough time and needs sound legal advise right away. Others can weigh in with their opinions as well.
