CONJUGAL?!

Hi everyone. I am a Permanent resident in Canada and we landed here last Mar 16, 2011. My son and my boyfriend for 6 years (my sons father) was left in the Philippines. I just wanna know if I can apply my Boyfriend as my conjugal partner although we didnot get the chance to live together even after having a son because we're too young. But know that we're both in our 20's and have been in a genuine relationship for 6 years, is this enough to qualify as a conjugal partner relationship?

and It says that you also need to be in the conjugal partnership for atleast 12 months, can I claim then that we have been in conjugal partnership since we we're in the philippines or just after I came here.. since when we were still applying for PR in canada, i declared (which is required) that we don't live together and that we are just in a boyfriend-girlfriend relationship. that's because i wasn't really aware of a relationship, such as conjugal partnership, when we were still in the philippines.

I hope someone can help us. I really wanna get my SON and my Partner here with me as soon as possible.

Without being rude... is marriage out of the question?
otherwise, I'm afraid i can't be of much help. I think you have to prove that you live together or have some mitigating reason why you can not marry or live together.

You declared in your PR application that you were just boyfriend/girlfriend, so you are going to have to stay with that. I am assuming your boyfriend was not medically examined. If you claim now that actually he is your conjugal partner starting from before you came to Canada, CIC will say you should have claimed that on your PR application, and will not let you sponsor him. So you should either marry him, or state that your relationship became closer after you came to Canada, and became conjugal after you came to Canada. You have to be in a conjugal relationship for one year before he is eligible.

canadianwoman: so it is actually possible to claim that if i landed here mar 16 2011, the date that we entered into conjugal relationship will be the same (mar16,2011)? so I have to wait till AFTER the 16th this moth before we can actually submit the application? i still have tons of questions. :) why is there no comjugal partner in the marital status in the application form? is there any toll free number i can call to actually ask for questions. i live in edmonton.

You landed on March 16, 2011, so if you claim that the conjugal relationship began that day, it is going to look very suspicious to CIC. Too suspicious - don't do it.
As well, for a conjugal sponsorship to succeed, there has to be some immigration barrier keeping you two apart. Since you were living in the same country for the six years of your relationship, you have no immigration barrier. Even now, there is nothing to prevent you from going back to your country and either living with him for a year or marrying him. (Not wanting to because of a job is not considered a good enough reason by CIC.) I don't think conjugal will work. Honestly, I would just marry him and sponsor him as a spouse.

If he will come here as a tourist, can i extend his stay for up to a year? so then we will be able to live together and apply as common-law-partners? can you give me some more possible options being marriage at the least? thanks.

If he comes on a tourist visa, yes you can extend it, but you may have to extend it several times. My husband extended his, we asked for a year, we got 3 months. So we are going to have to apply again. Conjugal is THE most difficult to prove, so your only options are marriage or common-law.

I don't know how long CIC would think is OK. The problem is, if you say your boyfriend is just a boyfriend when you are applying for your own PR, and when you land, it is just not believable to say he suddenly became your conjugal partner right after landing. If he was your conjugal partner before you landed, he should have been medically examined.
I'd wait several months at least, and expect the visa officer at interview to ask why and how your relationship changed from boyfriend/girlfriend to conjugal partners.

If he can get in as a tourist, he can extend his stay, and it would be possible to extend it long enough to live together for a year.
