Hi,

I am a Canadian PR holder.

My boyfriend is back in India. We are together since 3 years now. We lived together in India for over 1.5 years together.

Can I sponsor him for PR?

Please help me out.

When did you land in Canada? Had you been living together for 1 1/2 years when you landed? How did you get your PR? What was your marital status when you landed?

I landed 3 months back. yes we were living together when I moved to Canada and 1.5 years before that. I got my PR through express entry FSP. my marital status was and is SINGLE. I have never been married.

This is a serious relationship and we want to be able to stay together.

Your marital status was and is common-law and you committed misrepresentation by failing to declare and include your partner in your PR app. Because of that, he is forever excluded from the Family Class and you can never sponsor him.

  • the person you want to sponsor lives outside Canada

I actually was not aware of this at all. I was under an assumption we had to be married. How can I change this ??

Every IRCC application and guide clearly explains common-law.

You can renounce your PR status and reapply with your partner included.
 
Isn't there anything I can do ? We have proofs of living together and we did our masters together in the UK where we lived together as well.

I had no idea about common law before I got my PR. Recently (post landing is when I understood)

You can renounce and reapply with him included.

Again, common-law is clearly explained in the apps/guides, so IRCC doesn't accept "I didn't know".
 
Because my friend is in the same situation but she is yet to land for the first time in Canada.
Same here is it important to declare common law or we can just get married and apply because me and my partner are living from last 1.5 years and her process for pr application is under processing?
