After 1 year of Canadian experience, you will be eligible for CEC. You don't necessarily need a job to apply under EE. You can apply from back home as well.

Hi Asivad Anac, please i need your help and advise. I just graduated school and now working in Canada. i'M in the express entry pool withj 380 scores. I am now confused because of the foreign work experience i added to my profile. I am worried because i didn't add it to my past applications with CIC like study permit or work permit.

ThE foreign work experience is 1 year and i got the reference letter from the employer. Now, i'm planning to apply for provincial nominee. Will the changes in my personal history be a problem. Please, help me i am new in this forum.

I imagine that it won't be a problem. What you declare in your study permit and PR application can be different when it comes to work history. CIC doesn't ask for full disclosure regarding work history on either of those applications.

You can't apply for CEC till you have 1 year of full-time Canadian work experience but you can apply under FSWP and PNP.

Thank you so much for your quick response. An immigration lawyer collected $500 from me for consultancy fee to answer lots of questions for me. At the end of the day, he said that could be misrepresentation because i didn't include it in my previous applications with CIC.

My gf's sister recommended this forum to me. I qualify for the FSW and PNP. I will qualify for CEC next year April.

THe SP/WP and the EE application are two completely different processes. You are not required to declare your foreign experience for your SP/WP application since they add no value there (since you graduated from Canada, you will get a WP based on your education here).

Your EE application gives you value for your foreign experience, and hence you have declared it there. This is in no way misrepresentations. You will not get into any trouble if all the information you provided in the EE application is true.

Hope this helps!

Thank you so much for this reply... when u fill out your application for study permit, there is a place that ask for employment history... If you had that job back then, why didnt you include it on your study permit??? just be careful of misrepresentation. They keep track of all those so dont just be in a hurry to add more experience just to get points!
If you are not getting points for it but including it on your personal history then to me its fine... but not getting points for something you never declared on your study permit app... your UCI # brings up all information about you when logged on their system!

You are fine. As far as misrepresentation, ask yourself whether disclosing your foreign work experience could have resulted in denial of your student visa. Things that bring about a misrepresentation charge are those things that Canada considers important to your application, and that an applicant might withhold for fear of being rejected. They include things like a marriage that isn't real, the denial of prior visas or permits, a serious medical condition, or the existence of children, spouses, or relatives you might want to bring to Canada later but don't want to reveal currently.

That you worked for a year in another country can only help your application to Canada, not hurt it. You weren't required to disclose it, and mentioning it now is not going to result in a charge of misrepresentation.

Misrepresentation is not any fact that is different on different applications. The information has to be relevant to the decision-making process, and then there has to be reason to believe it was deliberately withheld - not as the result of a mistake or faulty memory - before it will be considered misrepresentation.

One thing that might happen, though, is that CIC might be very careful in confirming that the claimed experience is true, since it does qualify you for EE and yet you didn't mention it on your prior applications. CIC will know, and it may effect how they deal with that experience (they might want more evidence than a letter) but it really isn't a case for misrepresentation - unless they find out you didn't really have the work experience you are now reporting.
