Confusion over martial status

I have this situation and need urgent advise .

I have got my Visa and my landing is pending .

All throughout my process , my application was processed as single . My plan was to complete my landing process and then get married . Due to some unavoidable circumstances , I had to get married some days before my Visa arrived .

Now my dilemma is should I land with the current status or notify CIC about change in status ( potentially go through the entire waiting process again ) .

Now we have no plans to sponsor my spouse for PR anytime in future .

Before anybody can jump for conclusions , our marriage was pending for sometime due to pending divorce .

There is nothing fishy about this situation only thing is we could not get married in time.

Your Married now, you need to update your status with CIC. If you land and declare yourself single you will have misrepresented. If this is ever discovered it's quite possibly you could have your PR or even Canadian citizenship revoked.

It sounds like you already know this but you could also NEVER sponsor your wife.

Its obviously your choice but updating would be the best thing to do for peace of mind.

You MUST inform CIC. Your COPR is invalid now and you will be breaking immigration law if you land as "single" when you are in fact "married". Misrepresentation is not a "choice", it's actually a crime.

What is the process after informing CIC . Do I get a choice not to include my spouse in the application .

We do not plan to apply PR for my spouse .

No, your spouse will have to be examined, regardless of their current intentions. They can be added as non-accompanying but that will not prevent a delay for them to submit the required information /medical examination results.

When I said choice what I was actually saying was it's you're choice whether to lie or not :)

You must include all family members on your application you can not choose to exclude them.
You would update by sending updated forms to the visa office which processed your application.

I am abosultely stunned by something i learned today ...

My husband informed me today that he was married before and his divorce is still pending . I had no idea about this and this came out whe n I infomred him that CIC will do a background check on him . CIC will definitely find this fact and reject his application .

what should I do now . According the cic , my application will be rejected if his application is rejected .

I am in a total mess . I worked so hard for this and everything has collapsed now .

Please help

You are not the only one confused over your status. I can't figure out how this scenario goes between your first post of wanting to get PR as single in first post but having to get married, and the last post saying you aren't legally married and you are dependent on your husband's application to get PR. Maybe I am just tired, but I don't get it????

You are not the only one... Maybe there is some account sharing going on?

Start at the very beginning and tell us *everything*. Your history is very confusing. We need to understand three basic things.

1) Who exactly is involved in this saga?
2) What are you trying to achieve?
3) What are the dates of all the significant events?

It seems that you are not legally married. If this is in fact true, you certainly don't need a divorce...

I am not an expert, but it looks like you can check 4. off the list if you aren't legally married, so no spouse there goes 3., too. Now 2. If you are on your husband's application (is he the primary applicant?) then reporting fraud is going to have consequences for you getting to Canada, too. Did he need you to get enough points for his application to be accepted? If you are the primary and have sufficient points in your own right, you have the option to eventually marry or apply as the single person who wanted to in first posting. And at the top of the list now 1. Where do you go from here? Well you don't want to be charged with misrepresentation, so you have to inform CIC and wait for the divorce to become official, decide if the relationship will survive this issue, get married and start over. My question is, how did the marriage ceremony happen in the first place? Isn't there a legal record search done? Don't you have to state that there is no impediment to this legal union? Don't they ask the congregation the same thing? And finally, you still haven't explained how the first posting on this thread relates to this present situation. Something doesn't add up.

Is it possible that you applied and got accepted for PR on your own SINGLE status application? As you are NOT legally married now, that status remains Single. If you have all your approved documents, I don't see
What the problem is with the visa? With the relationship, well that is your issue. Why marry someone you have no desire to include in an immigration application? If your marriage was pending outcome of a divorce, you had to know he was married, yet you state he only informed you recently of his previous and still ongoing marriage to another. Agree with Zardoz, no one can help further with facts as presented.

Since technically you are not married, complete your landing activities get the PR. you can sort out marriage dispute later on.
