Hi All,

This is my situation... I was on my post graduate work permit which ended last year and prior to that i applied for an open permit on the basis of my spousal sponsorship...My lawyer sent both the applications together (I dont know, how does that work).

But now my relationship with my gf is has gotten little rough and I am afraid she might withdraw the application.(which is fine because I am eligible under CEC as well).

Now my question(s) are ...

1) what happens if she withdraws the application after I receive my first approval/work permit ??

2) Will I still be able to use that work permit , if she withdraws the application?

3) If I get my work permit and she withdraws the application , should I apply for another open work permit with my CEC application? How does it work?
Or I will have to apply for a bridging work permit?

4) And if so how much time doesn it take before I get my first approval for CEC??

5) My lawyer said he would apply for a work permit for me on the basis of my cec application , like he did for spousal?? How in this world does that work?

Please advise. I am in a complex situation and my lawyers ripping me off .

I am planning to do my CEC myself since its very straight forward.

I'll help you with a few of your questions.

1) If she withdraws the application you lose your open work permit.
2) No - you won't.
3) You will have to wait until you qualify to apply for a bridging work permit.
4) Don't know.
5) Your lawyer must be talking about the bridging work permit.

Thanks for the reply,

So if I apply for bridging work permit and then she withdraws the application while my bridging work permit is in process.
Will I be under implied status?

And also I called cic today and asked them about the work permit and they told me "once the work permit is issued I can keep using the work permit till it expires.Even if she withdraws the application."

But you tell me it will go void . So I am little confused now. ???

Hi

I dont know what was the source of your info but just to let you know If I get my work permit and she withdraws the applicaiton , I will still be able to use that work permit till its expiry date.

Confirmed it with CIC and my lawyer said the same. So I will get a buffer to ge the first approval from CEC and apply for my bridging work permit.

I'd trust scylla over any immigration lawyer or the CIC call centre anyday. Both have told me 100% absolutely incorrect information.

Call CIC back and ask the agent to email you the policy so you have it in writing.

Ask your lawyer for a copy of the policy.

Also ask if transitioning from OWP with Inland application (with application cancelled) to the BOWP with CEC would give you Implied Status. Ask for that policy as well.

If this information is wrong, do you think your lawyer or the agents will admit they gave you bad information? No, only you will be punished. I wouldn't risk it.

Can a CIC agent email me like that?

I would definitely have it written from them to be on the safe side.

But I have called them twice and I got the same reply.

I would definitely have that in writing but even having that in writing wouldnt help once I get the application rejected.

And over that I am really hoping for this because if this is not the case I might have to just wait till I get my PR from CEC. and wont be able to work during the wait. :(


Also If you could answer another question for me pls.

I have the T4 for 9 months of my experience and after that i have been working as a contractor and I have T4A from my employer for last year.
Will T4A and the reference letter from my employer work to apply under CEC.

Any feedback will be much appreciated .

But its same for all the cic documents. Once they are issued by the government. They are valid till ther expiry and she was the third call agent who told me the same.

So I am confident about it and same goes for the implied status that you mentioned as well.

This should be a red flag.

As I understand it, the IEC visa is not exendable (but you can apply for a second visa for some countries). Non-extendable visas are not covered by Implied Status. It would the same if you changed from Visitor to Worker. You can't start working just because you applied for a work permit. You have to wait until the work permit is in hand.

But it's your life and your choice.

So I am on an open work permit right now which is PGWP and have applied for spousal work permit which i hope to receive and will apply for bridging while i am on spousal permit ....So dont think I will have to really actually be on implied status , however I am implied status now... But lets see..
