Complicated Application: I am a Canadian Citizen looking to sponsor my British Husband for PR. As I am starting to embark on this application journey I would really appreciate your advice and expertise in helping me answer a few starter questions.

My situation is as follows:

I’m a Canadian Citizen who has been living in the UK with my husband for the past 2 years on a UK Marriage Visa that will expire in April 2020. We have been together for over 11 years and married for 3. We recently found out that we are expecting our first child in 2020 and this made us decide to move to Canada and raise our family there. We are planning on BOTH going to Canada in September of this year as I will still be able to fly and would like to deliver my baby IN Canada. We will BOTH be coming to Canada (my husband as a visitor) and giving up our flat/residence here in the UK. My husband has been the sole income earner for us and is Self-Employed. He will be stopping his work and I will be the one looking for employment and/or starting my own business once in Canada. We are planning on submitting an Inland application after we arrive in Canada (because my husband would like an OWP, because we are giving up our flat here in the UK, and because we want to ensure that he can remain in Canada for the birth and after baby is born. We are aware of the length of processing time and that he won’t be able to travel)

Here are my questions:

1. Will me having an already existing spousal visa for the UK affect his PR application? (Will it raise a red flag as to why we recently went through immigration process in one country and now doing it again in a different country). Note: I did not officially cut ties with Canada or submit any formal non-resident status.

2. If we both travel together to Canada in September before submitting the application, how can we insure that he will be allowed in as a Visitor? I’m aware of cases where the PA was denied entry because he was a risk of overstay. Can we not just say that he is visiting as he will have a return ticket and because we have technically not sent application yet. Do we HAVE to divulge our intent on applying for PR? Does having an eTA help?

3. If we apply Inland, can we send the application out before we move in September? We already know we are going to be living with family in Canada so we have an address to use already. Can we send the application from here even if it’s for Inland or will it bring up a red flag as to why the package is coming from the UK?

4. How does my husband get a Police Check, Biometrics, Medical if he is NOT residing in the UK and only in Canada as a visitor? Does he mail a request for the Police Check to the UK? Can he get the medical and biometrics done in Canada or does he have to go back to the UK for those? Can he get these things done before we leave the UK or do we have to wait until they request them?

5. In 2011 my husband joined me in Canada for 6 months and he applied for a visitor visa extension for another 2 months making is stay a total of 8 months. Does this mean that he will need a Police Check for Canada as well?

6. Because I have been in the UK for 2 years, I have not filed Canadian income tax during this time, though I do NOT owe any back taxes because my income is not high enough. Will this harm my Sponsorship application? Again, I never filled out or submitted any official application for non-resident status.

7. Does cohabitation proof HAVE to be in Canada for Inland applications? We have proof of our cohabitation here in the UK for the past 2 years does that meet the requirement? Since we won’t be in Canada until September, we don’t have any proof of our cohabitation in Canada yet. So if we apply Inland, will it be a red flag that we don’t have proof of our cohabitation in Canada? If so, what’s the easiest and quickest way of getting proof once we arrive in Canada?

8. Since I’ve been in the UK for 2 years and have not been working I do not have a job/income in Canada. Is this a red flag for Inland applications? We are submitting our application as soon as we get to Canada so I won’t have time to get a job so I am planning on submitting a concise business plan for my business I hope to start in Canada, a letter from an employer who has expressed interest in hiring me (not a formal job offer but a letter stating interest), my resume stating my skills, experience, and education, a letter from my parents who are willing to help support us through accommodation, food, and finances if need be, and a detailed letter from myself stating how I intend on supporting us. Is this enough to satisfy the financial support for Sponsorship approval? What do I put on the application form in the section when it asks to list employment history? Do I put N/A or list last employment from over 8 years ago?

9. When we apply we will be living with my parents as we won’t yet have a residence of our own. Is this acceptable for Inland applications?

10. Since we had to gather similar documentation for my UK visa, can we submit the same documents we used back in 2016 such as family affidavits, notarized passport copies, utility bills, phone records, cohabitation proof or will it look suspicious because they are three years old?

11. I as the sponsor am not receiving any social assistance/welfare from the Canadian government but my husband the PA IS currently receiving government assistance in the UK. Does this affect his application?

1. No - it won't.
2. It's mandatory that he have an eTA to travel to Canada. This isn't optional. He won't be able to board a plane without an eTA. Yes - he should have a return ticket.
3. No - not possible. You can only submit the application once you are both in Canada.
4. Medical can be done in Canada. He can get the PCC through mail. Biometrics cannot be done in Canada - not sure how this works. I'm sure someone else will comment.
5. No.
6. No.
7. Not required if you are married.
8. & 11. This is problematic. IRCC wants assurances that your spouse won't go on social assistance and that you have the financial means to support him. Given he is currently on assistance and you aren't working, you aren't able to demonstrate this and this will be a concern for IRCC. This isn't good for your sponsorship application and puts you on a potential path for refusal. I would very strongly recommend that you hold off submitting the application until you are working full time in Canada and can submit a few pay stubs to show this as evidence with the application. Keep in mind that you cannot take social assistance in Canada while his application is being processed (this will result in refusal) and neither of you can go on social assistance for three years after he becomes a PR (if you do, you'll have to repay this to the government).

Thanks for your response Scylla. In regards to your response for #2 Do you think it's fine for my husband to come as a Visitor and not mention that we are applying for PR or should he declare "Dual Intent"?
I would not mention dual intent. I would simply enter Canada as a visitor with a return ticket. Dual intent can sometimes go the wrong way on people at the border.

Good to know. Do you think that applying so soon after we arrive will be a red flag? I am currently compiling the application/documents here in the UK before we go to Canada in September. Once there we hope to submit the application right away. Will that look suspicious that he came through the border/immigration as a visitor only a few weeks before applying Inland?

Thanks for the encouragement Hurlabrick, I think "overthinking" is a bi-product of this immigration process haha

Any thoughts/advice on Proof of Relationship section where it asks for proof of living together? We are applying INLAND but will only have been in Canada a few weeks so what kind of things can we get quickly to show this proof? Keep in mind the PA is a Visitor from a visa-exempt country and doesn't have a UK drivers licence so it may be difficult opening a bank account, getting car insurance, etc. We have proof of living together from here in the UK but not in Canada.

I think you can start your application even if you are not in Canada. Canadian citizens need not to be in Canada to sponsor spouse. You might like to check it out.

Your situation really is not complicated.

Biometrics are not required for inland apps.

You can use cohabitation proofs from the UK.

Nice to hear that my situation isn't complicated! Thanks for the encouragement. I guess I'm a little nervous just because of how soon we will be arriving in Canada before we apply and how this means I won't have a job or income yet. I understand that income is not a requirement but it's always scary when it's a subjective situation up to the immigration officer's opinion on whether they think I can support the PA. You seem to have A LOT of experience on this forum, so I'd appreciate your input on whether you think I have a good chance of being approved for sponsorship or not based on what I wrote in the original post to explain how I intend on supporting the PA and that I don't have a criminal record, debt, bankrupt, or any other issues. Thanks in advance.
